Make sure the builder pressure flushes all the oil passages really good. Don't want to start the engine and start pumping old debris threw it. Same goes with the oil pan.

I would let the builder decide personally. He's been good about fixing issues and I'm sure he doesn't want to create another one by saving the cost of new rings if he thought there was a chance of them not working

I thought someone would have told you no already, but I have actually done exactly that and it did not create any issues.

UPDATE
UPDATE
Well i got my car back last week it has about 150 miles on it since rebuild. He installed new oil pump, bearings, 2pc oil pan, gasgets, New Callies compstar Crank, the car now has 5-30 oil ,holding 40psi at idle 55 psi going down interstate, its running great, It wound up costing me $1,600 out of pocket . he said i could use the old crank but it would be at 30 thousands , And if i was going to keep the car i would have never been happy with that inside my motor. So i feel i was very fortunate that Ed did what he did to help me .
As for the 50wt oil, he says he built the original 402 loose so it needed that to get the pressure up, I say it was built to damn loose and i think the damage started on the dyno when he broke the motor in and tuned it ,
Still waiting on reciept for the $1000 crank, And he says he sold the old one.

I'd push for the receipt on the crank, just to be sure.
Sounds like it is working out though.. did he end up reusing the rings? No issues?
