Default Signature was forged

by someone at the dealership where my friend bought his car. Apparently they forgot to have some forms signed and then were sent to him and they were blank. It was not the bill of sale but rather a dealer agreement pricing form. He contacted the sales rep and was told he would get a completed copy once they get it back. Never happened, after much hounding on his part, a form was mailed to him (un-signed by dealeship) but was signed and initialed by someone at the dealership.

Any opinions/advice on this.

While I'm certainly not condoning forging anyone's signature for any reason was your friend damaged in some way? Was a rebate stolen etc.. Or was it just a paper to title or register a car?

If it was just a form for something and no harm was done personally I would just forget about it... "Basically a no harm no foul" thing. If he just wants to make trouble than thats his/her right... Now if some harm was done, thats another story and he/she certainly has the right to damages..

Forging documents is a serious thing... But to me it would depend on what it was and why the dealer did it.. I had to sign a couple of minor docs that my dealer about 200 miles from where my house is forgot at delivery and in truth I asked him just to sign it for me, he wouldn't so back and forth by overnight mail went the docs... If he had signed them for me I couldn't have cared less, it was just an oversight on a delivery receipt and registration paper... But thats me and everyone is different..

Default C6 related ?

Is this a C6 we're talking about ? If so, why isn't that person doing the asking. If the car in question is not a C6, the question should be posted to the correct forum.

if he has a question which might lead to the breaking of the laws, he should contact an attorney. asking legal questions on a car forum is not such a good idea.

When doing paperwork, on a new deal, most dealerships have the buyer sign a "POA" to clear up any details with transfer of ownership. This is commonplace with both a used trade and a new vehicle.

Contact the dealer and get specifics........if you like!

POA = Power of Attorney

Under POA, someone can sign on your behalf but they would sign their own name, not yours.

I would not tolerate someone signing MY name, unless I specifically authorized it. Depending on the situation, it could be a big deal but likely not in this case if it is a standard form that must be signed to do the deal. They should have called you and asked you to sign, Fax (scanned emails) signatures are legal pretty well everywhere nowadays and can

If the document contains terms you don't agree with, get it voided, call a lawyer if need be - if it contains terms you do agree with, void it anyway and sing a new one yourself

I agree with the above statement. The reason for the post was not asking for legal advice, just some opinions from others who may have experienced something like this in the past or know someone with a similar issue. I personally wouldn't want someone signing my name to anything without asking for permission. Thanks to those who commented.

He will be joining once he returns to the states and gets a little more time. Thanks again.

This is a moot subject until we know exactly what forums are being discussed/questioned as forms vary by state.

Your description of the form is vague so hard to know what form wasn't signed. However, there are a lot of forms involved in new car sales now that have nothing to do with buying or selling the car but to document something was done to satisfy a private or governmental group monitoring such transaction to make sure you weren't cheated. The last time I purchased a new car I thought my hand was going to wear out with all of the forms they had us signing. The vast majority of them had nothing to do with the financing, registration or licensing of the car. If it was one of those forms its sort of a "So What?"

Sort of like all the paperwork you have to fill out when you go to the doctors office. You walk out with wads of paper that have statements you were informed of this and that and so on and which you throw in the nearest shredder.

Bill
