Hang in there. My car was in the shop for 5 weeks but it was fixed. However I have more to the story as I am still dealing with GM on another issue. More to come.

Differential finally made it to the shop. Car supposed to be ready by the end of the week. Dealer says GM only pays them eight hours for this job, so not sure why they're saying end of the week. But anyway, now comes a big bill on my part then a wait, and hopefully not a fight for reimbursement after a wait for GM engineering to determine if I'm at fault. I continue to tell the dealer than I have no control over the differential other than the car's speed.
I asked the dealer to double check with the mechanic to make sure there weren't any computer problems related to this. Obviously the differential was cooked, but I'm still suspicious that spurious signals from the diff clutch computer could have caused the problem. Especially since I've had a previous "service rear axle" warning that was "fixed" by a reboot of this computer.

When things have gone south at the local level I have had much better luck writing a letter to the top person in GM (right now Mary Barra) asking for help. I state the problem, state what I have paid up to that point and what I want and will make me go away happy.
Everytime I have done that I have received a favorable outcome even when the local dealer service manager called me to say nothing would come of my complaint followed the next day by a non descript letter in the mail from that same dealership with a check for what I had paid. Somebody must have been hammered somewhere. Didn't have to pay a lawyer anything. Time duration from when I put the letter in my mailbox for pickup until complete resolution of the complaint was about 10 days.
If you don't ask you never give them the chance to say "Yes".

The way you have handled this situation was exactly how it should have been handled. The people that are criticizing you are the one's that believe in cutting off their nose to spite their face.
Hope GM refunds your money.
And if they don't, the cost is not going to change your lifestyle and your car is fixed and you can simply move on.

He said he will have to pay $5600 out of pocket, then wait for GM engineering to inspect his parts and determine a root cause of failure.
If GM decides the part assembly was defective, they will reimburse him, if they decide he caused the failure due to "abuse" then they will tell him to pound sand.
Personally, I would of never agreed to pay $5600 out of pocket. Even if he does get his money back it will take months, if not a year or more, to get it back.

Not necessarily, I would have escalated the issue before agreeing to pay that kind of money out of pocket. The car is warrantied for track use as long as it's not on racing tires. If the facts are what the OP posted there should have been no question of coverage.
