In movie theatres you still need to shut your phone off. How is driving any different? People shouldn't use their phones in the car.
But to answer your question. You can place multiple antennas in the car to determine the phones location. Or you can measure the distance from the antenna. Or a similar tech (phones broadcast all sorts of signals). Using one of them to figure out where the phone is, would not be prohibitively difficult.

All the "hands free" options on the steering wheel do help, but there is no such thing as "multitasking", many other studies show that what really happens is that our brains switch awareness, not that we are really paying attention to more than one thing. That switching may be rapid; a second or less, but it is still switching, not sharing awareness.
I reference the "we" as the vast majority of people, not the statistical anomaly.

So in terms of safety (where 0 is the most unsafe):
Using your phone to browse the Internet < Using your phone to send texts < Using your phone to make calls < Using your phone via your car's hands free (to do whatever that allows) < Talking to people in the car < just driving and doing nothing else.
I'd say clearly we can agree that the line should go NO LOWER than "Using your phone via your car's hands free (to do whatever that allows)" However maybe we need to regulate what the system is allowed to do. Clearly we need to regulate the ability to use the phone (the lower 3 states) as drivers have shown they do not have the intelligence (or caution) to not do those things.
