received a citation for my dog barking... question?

Default received a citation for my dog barking... question?

Yeah, so the Animal Control officer calls me at school and says:

Her: "Lcpl Mclovin, I'm standing in your front yard and your dog continues to bark..."

Me: "no chit, you're trespassing... try standing in the street and I bet he'll stop"

Her: "oh yeah, you're right... but I still have to issue a citation since this is the second complaint"

Me: "when was the first?"

so anyway, I get home and she can't, for whatever reason, tell me who called them and filed two complaints on my dog's barking. So now I have this $200 ticket and no one to hone my MCMAP skills on. I've spoken (friendly) with every neighbor within a half mile and everyone swears they never called or even heard my dog barking excessively.

*one neighbor did, however, say he saw an elderly woman in a black SUV parked in my driveway on her cellphone... I'm not aware of any of my neighbors fitting that description so my question is, can I just drive halfway across town, trespass, and call Animal Control when someone's dog starts barking? If I fight this ticket, do I have a leg to stand on? Can I go as far as to bring up my 6th amendment rights and request to see my accuser?

Lol, no, he is very well taken care of. He's an 'inside' dog that I'll let outside for 3-4 hours while I'm in school if the weather is nice.

I think his breed (AKC registered champion American Staffordshire Terrier) may have something to do with the whole situation

Mail the city a cheque for $205 along with the citation, they won't cash it because of they won't match up (accounting reasons).

Cannot stand neighbors who do not control their dogs. I have called the HOA and Animal control on neighbors with dogs that yap constantly for no reason. 'Quiet enjoyment' is my right.

I subtly told one of neighbors that if I was still living in NY the neighborhood barking dog would have been shot already. I never heard it bark again. I guess word got around to the offending neighbor pretty quick.

most cities, counties, etc., will investigate after two complaints. These places have a "barking dog law" in place. Sounds like you owe 200 bucks. no offense.

Typically most animal control officers have to witness the dogs barking. Just because someone called in a complaint doesn't mean it's a strike against you. I don't know why you were never notified if the first complaint, but you should have been.

As far as the neighbors go do you really believe that they would tell you if they called on you?

You also have no idea how much your dogs barks all day when you are not home. I have a neighbor who's dogs bark from the time she leaves until she gets home. I informed her, but the bitch still let's the dogs outside to bark on a regular basis. I now will not hesitate for a second to call on her.

Just got done doing this.

We have a row of houses here that all have dogs. Five houses altogether. They all let them out when they get home from work at about the same time.

The dogs all like to bark at each other. I had no problem with that. Hey, its what dogs do.

Recently the barking has been going on until 10, 11:00pm at night every night of the week. Six hours is alittle much IMHO. Went and talked to the offenders.

Every last one of them said that they had the right to keep the dogs out as long as they wanted and I should just STFU. Hhhhuuummmm.

I called all of them in. They all got tickets when the animal control people saw what was going on. Two dogs got taken in to the pound. Problem solved.

Peace and quite has been restored.
