Lyons OKs 'unprecedented' gun shop regulations

Midwest Sporting Goods, which has operated a gun store in Lyons for more than 50 years, must follow an unprecedented set of rules, such as maintaining a "do not sell" list of customers whose weapons have been traced to a crime. In addition, the gun shop will have to report to authorities the names of anyone who attempts to purchase a gun illegally.

"INFORMATION ALERT - CHIEF'S CONVENTION A GUN-CONTROL CIRCUS

The rabidly anti-gun International Association of Chiefs of Police rolled into Chicago this past weekend to hold its annual convention at McCormick Place. With the bloodstained streets of the South Side as a backdrop, the Chiefs attacked lawful gun owners, vilified the NRA, and called for the end of civilian firearm ownership as we know it.

As one would expect, Chicago's cartoon-character police superintendent Garry McCarthy delivered the welcoming address to those in attendance. While doing so, McCarthy made clear his fervent belief that the state's lawful firearm owners were at the root of Chicago's violent crime problem. McCarthy emphatically asserted that regular citizens, such as dentists, lawyers and accountants living in Naperville, must be relieved of their firearms so that drug lords in Chicago will stop shooting one another. One need not have a very cynical eye to recognize that McCarthy's fixation on civilian disarmament serves as a mere distraction from the real problem - woeful mismanagement of Chicago's police department.

For many years, the Chicago Police Department's Detective Bureau published an annual report analyzing numerous factors impacting the city's homicide rate. Publication of the homicide report was an unusually transparent endeavor for a Chicago governmental agency. Available to the general public, the homicide report chronicled the good, the bad, and the ugly of the Chicago Police Department's crime fighting efforts. The report also provided facts to support effective rebuttals to assertions made by the gun control movement. Publication of the annual homicide report ceased after the 2011 edition. Coincidently, 2011 was the year that Gerry McCarthy became the Chicago Police Department's Superintendent.

Tidbits taken from the 2011 Chicago Murder Analysis paint a picture that does little to support disarming law-abiding Illinois citizens:
Chicago has 25 police precincts - 8 of them account for about 67% of the murders committed in 2011

A full 68% of Chicago's murders in 2011 happened in streets or alleyways

In 1991, 67% of the murders that year resulted in arrest and prosecution. In 2011, only 30% of the murders committed that year resulted in arrest and prosecution

Of the 312 murders committed in Chicago in 2011 where a motive could be determined, 51% were incidental to gang or narcotics activities

Of the 433 people murdered in Chicago in 2011, 75.3% were Black, 18.9% were Hispanic, 4.6% White, and 1.4% Asian or other race

In instances where the race of murder offenders could be determined, 70.5% were Black, 24.3 were Hispanic and 3.5% were White

77% of Chicago's murder victims in 2011 had previous arrest records

87.3% of murder offenders in 2011 had previous arrest records

Of the 433 murders occurring in Chicago in 2011, 362 were committed with a firearm - 351 utilizing a handgun; 1 utilizing a rifle; 5 utilizing a shotgun and; 5 of unknown type

42% of murders take place between 10:00 PM and 7:00 AM
Based on Chicago's 2011 murder statistics, there's a good chance that you'll either commit a murder or become a victim of a murder if you are a young adult male night-owl gang member with a previous criminal record who hangs out on the streets of certain police precincts. Otherwise, you'll probably live a long and uneventful life. But, if you do get killed in Chicago, there's a 70% chance that the person who killed you will never face justice.

Of course, these statistics are from 2011 and, since these statistics are no longer published, we have absolutely no idea if the McCarthy regime has at all quelled the criminal blood lust on Chicago's south and west sides. Yet, we suspect things haven't gotten any better since McCarthy took office.

One thing that hasn't changed since 2011 is the abject hatred Chicago officials hold for lawful gun owners. The post-Daley years have seen no let-up in the city's concerted effort to eliminate private firearm ownership. Their very own facts notwithstanding, Chicago city officials lay the blame for criminal and gangland violence on law-abiding citizens who wish to do nothing more than exercise their constitutional rights free of interference from sawed-off dictators like Rahm Emanuel.

Joining McCarthy in last week's orgy of gun hatred was Barack Obama. In his address to the Chiefs, Obama cynically tried to allay the fears of gun owners by saying that he was not going to take anyone's guns away. However, in his next breath, Obama pushed the Chiefs to support legislation that would ban better than 80% of the firearms now in civilian hands.

When on friendly turf such as the Chiefs' convention, gun grabbers like McCarthy and Obama lose their inhibitions and speak freely of their plans to punish citizens who dare to own firearms. After listening to the addresses made at the Chiefs, it should be clear to all gun owners that Obama and his ilk have no respect for our Constitution and the liberties it is designed to protect.

As a gun owner, the only way to survive is for you want to keep your guns more than the gun-grabbers want to take them away. That means that all gun owners will have to put more effort into protecting the 2nd Amendment - at all levels - than the gun-haters put into destroying our heritage. Only you can protect your gun rights. So, get involved, get vocal, get in the faces of the gun controllers. Force them to back down - force them to abandon their morally-bankrupt campaign for domestic disarmament."

"NRA has learned that a proposal will be introduced on Monday to impose a tax on firearms and ammunition, similar to proposals reported on in the past.

This proposal creates a tax on firearm purchases, and would therefore penalize law-abiding gun owners for exercising their fundamental right to keep and bear arms. By definition, holders of a valid FOID card are the only persons legally permitted to purchase a firearm in Illinois, and therefore are the only persons subject to this tax – not the criminals responsible for the violence on the streets of Chicago. Studies by the Bureau of Justice Statistics have shown that less than one percent of state prison inmates who were behind bars for a firearm-related crime obtained their firearms from gun shops. Instead, most obtain guns through theft or black market transactions.

As gun ownership and legal carrying of firearms elsewhere have risen to all-time highs, the nation’s murder rate has fallen to nearly an all-time low, and both the nation’s murder rate and its total violent crime rate have fallen by half in the last 20 years. Despite all evidence to the contrary, Cook County politicians continue to blame law-abiding gun owners and legal, licensed dealers, for their failure to respond appropriately to the problems plaguing their community.

As Chicago-area jurisdictions have learned in court, the right to keep and bear arms is fundamental, and any revenue raised by this additional burden on citizens exercising that right is likely to be consumed by costly litigation and attorney’s fees. Federal and Illinois courts have consistently held that discriminatory taxes on the exercise of fundamental rights are unconstitutional. For example, the U.S. Supreme Court struck down a tax on the cost of paper and ink used to produce publications because “[a] power to tax differentially, as opposed to a power to tax generally, gives a government a powerful weapon against the taxpayer selected.” Minneapolis Star and Tribune Co. v. Minnesota Com’r of Revenue, 460 U.S. 575 (1983). Likewise, the Illinois Supreme Court struck down a surcharge on marriage license fees to fund domestic violence programs because people “forced by the tax imposed to alter their marriage plans” would suffer “a serious intrusion into their freedom of choice in an area in which [the court had] held such freedom to be fundamental.” Boynton v. Kusper, 494 N.E.2d 135 (Ill. 1986).

The Cook County Commissioners are proposing to continue a failed policy of passing illegitimate and ineffective legislation in order to unfairly burden honest citizens and drive lawful businesses out of Cook County.

Cook County Board President Toni Preckwinkle officially announced today her intention to pass the county’s first round of ammunition taxes during this Friday’s county board meeting. Gov. Bruce Rauner says the state of Illinois will temporarily stop accepting new Syrian refugees in the aftermath of the terrorist attacks in Paris.

Rauner said Monday that Illinois will consider all of its legal options pending a review of U.S. Department and Homeland Security's acceptance and security processes. Rauner is one of several U.S. governors who say they will stop allowing Syrian refugees into their states after the Friday night attacks in Paris left at least 129 people dead.

Rauner says Illinois has to balance its tradition of welcoming refugees while "ensuring the safety and security of our citizens."

Gov. Mike Pence says he is telling all state agencies to suspend the resettlement of additional Syrian refugees in Indiana following the deadly attacks in Paris.

Pence issued a statement Monday saying he was putting all resettlements on hold until assurances from the federal government that proper security measures have been met. He says Indiana has a long tradition of opening its arms and homes to refugees, but as governor it's his first responsibility to ensure the safety and security of Indiana residents.

He says the policy will remain in effect until the state of Indiana receives assurances from the federal government that proper security measures are in place.

But a proposed change to a nearby gun range is making them rethink that decision. "Every evening of every day, including weekends, there will be shooting," David Eder said. The Byron Oregon Sportsman's Conservation Club, just a quarter mile from the Eder's, wants to expand.

Cook County Board President Toni Preckwinkle's $4.5 billion budget won approval Wednesday, and people who shop, stay in hotels and file lawsuits will be paying more next year.

Overall county spending is expected to increase by about $500 million under a budget commissioners approved 12-5. The spending plan depends on a penny-on-the-dollar sales tax increase, a new 1 percent tax on hotels and $20 in additional fees for each lawsuit filed.

Preckwinkle's budget also includes a 20-cents-per-milliliter tax on the liquids that fuel electronic cigarettes and a bullet tax that ranges from 1 cent to 5 cents per round, depending on the type of ammunition.

An assault weapon ban passed by the City of Highland Park in 2013 and challenged by a local pediatrician will remain intact.

The United States Supreme Court decided Dec. 7 not to hear the appeal of Highland Park pediatrician Arie Friedman and the Illinois State Rifle Association challenging the city’s constitutionality of the ban that could lead to it being overturned, according to a Supreme Court spokesperson.

A state representative has filed legislation that would prohibit local governments from placing their own taxes on guns and ammunition, something more places have been considering.

House Bill 4348 would bar the addition of any new tax, fee or other charge beyond the normal sales tax. It would also invalidate such existing taxes, and it would apply to both home rule and non-home rule units of government.

“At the end of the day, obviously I believe the right to bear arms is a constitutional right,” state Rep. Jerry Costello II said.

“I don’t believe that communities have the right to make defending yourself a socio-economic issue, and the less fortunate have just as much of a constitutional right to defend themselves as every other citizen in the state,” said Costello, D-Smithton.

Todd Vandermyde, the National Rifle Association’s legislative liaison for Illinois, said the NRA supports Costello’s bill.

CHICAGO (CN) - The Seventh Circuit upheld an Illinois law requiring that anyone age 18 to 20 trying to buy a gun must have a parent or guardian sign the permit form.

Tempest Horsley challenged the law when the Illinois State Police returned as incomplete an application she completed for an Illinois Firearm Owners' Identification Card (FOID) upon turning 18 years old.

On Dec. 17, Guns Save Life Inc., a group which purports to include members in Cook County and throughout Illinois, filed suit in Cook County Circuit Court against the county, the head of its Department of Revenue and Cook County Sheriff Tom Dart, alleging the county violated the U.S. and Illinois state constitutions in enacting the special tax on guns and ammo.
