Track ready lawsuit underway
for the Ford Shelby 350. Perhaps 2015 and 16 owners should call this lawyer to motivate the swap program Tadge talked about.

Buncha cry babies. They bought a non-track pack car and are upset when it overheats on track. A6/8 owners buy automatics, upset about the extra heat. A stock C5/6 were not good "track" cars. Just about any dedicated track car I see at an event has been upgraded to overcome manufacturer short-comings. Nature of the beast.

Unfortunately, the result of most class action lawsuits is that attorneys get their massive fees and plaintiffs get a $10 off coupon good at the company store.

So these genius Mustang owners purchased the "non-Track Pack GT350", drive it on a track, then complain and sue when it doesn't perform like the "Track Pack" version". Is this how I am understanding it? This isn't helping our cause...

Another hungry law firm with scumbag lawyers that are looking for a pay day. It's a fishing expedition to see how far they can get. Lawyers sue all big companies and at the end settle for few dollars. They count on volumes as all these settlements will add up. No real winners.
As others said, owners had the chance to order track option for 5k which would have included the coolers. Now ford raised the base price by 5k and includes the coolers on all MY 2017.

been through this before.Z06 is TRACK CAPABLE,NOT TRACK READY.look up my post where I posted the Z brochure.Gm states this.

Well Ford said 'track ready' they didn't have to say anything. GM never said take our (street sports car) onto a race track. Overheating Z06's soon came about. I don't blame GM for that.

"The most track capable vette ever"? And that is not misleading? Why include the word"track" if you knew it would overheat on a track? At the very least that is a deceptive statement suckering buyers in that when it is made widely known overheating occurs tanks the value of the car and buries people in them financially. I for one am ticked about it.

So GM provides an aux radiator and heightens the supercharger lid for the newer models and markets the CZ7 and Grandsport on tracks. Really...sign me up for something.

In 15 and 16 you could get either the track pack or tech pack cars (or the ADM rich R). If you opted for the track pack cars you got tranny coolers which I consider crucial as the car was designed with the cats very close to the tranny, helping to heat up the tranny during aggressive driving. Many users bought the tech cars as the seats were leather and not as heavily bolstered and the cars had upgraded infotainment. Some guys with tech pack cars have reported hitting limp mode on the street during spirited driving, albeit, very few.

There are no implied claims specifically about how well it performs on a track. Under the laws related to "merchantability" (which is what you're arguing--merchantability deals with what any product does vs. expectation of product from a "reasonable" purchaser) the court would find in favor of GM every time if an owner sued because they bought a Corvette Z06 for the track based solely on the slogan "track capable". Can you make it 1-2 laps around an "average" track without the car having catastrophic failure? If so, under the laws of "merchantability", it's absolutely "track capable".
Remember the old GM slogan/advertisement for the Silverado..."Like a Rock"? If you buy a 1990's Silverado and ram it at 20 mph into a 50,000 pound boulder and total the truck, then sue GM, you think you can claim "Well--it said 'Like a Rock' so I figured it should be able to disintegrate the rock?" It's just marketing. It didn't specifically say "Can be driven into and destroy rocks". It is just analogous to how "tough" or "durable" the product is...not a recommendation or implied claim that it can actually "take out" a rock.
Listen...I feel for you as a fellow Corvette owner. Would I personally expect your Z06 to make it around a track for a few hours without overheating issues? Yes. But based on their generic claim, you just don't have a case.
As for the overhearing issues related to the value of the car...I assure you the relationship is minuscule, if not non-existent. Just like somebody bought my C5 brand new for over $42k in 2000 and I bought it for under $20k with just 19,000 miles...all cars depreciate hard as they age. Especially now that the technology in new cars is advancing at an unbelievable pace each 2-3 years. With technology advancing so quickly in New cars, cars are depreciating at the fastest pace in years...if not ever. Whereas a car like a Corvette may have depreciated at a rate of 5% per year in the past, it's now more like 7-10%.
It sucks, but it's happening to all cars. My family bought a brand new Malibu in 2013 for $25k. With just 40,000 miles, in perfect condition...it's maybe worth $14k, if that. In the past, a mid-sized sedan at 4 years old with 40k miles bought new for $25k would probably be worth like $17k-$19k. Advancements in technology are rendering cars 3-4 years old somewhat "obsolete"...tanking 're-sale.
I will say this...judging by how awesome my C5 performs, I bet your car is a beast. I'm jealous.
