Most likely not. If anything, they'll send an amendment letter.

I beat a ticket once when the Cop wrote me up for the wrong vehicle code. Judge dismissed it! I would think the color of the car and your age wouldn't matter if they have your DL number. By the way, where did you get the ticket? How could he see inside the car to determine you weren't wearing your seatbelt?

While I would also advise you to start wearing your seatbelt, I personally think you have the beginnings of a great written decleration as to why this officer has poor observation skills. I'll let you figure out the rest, but I think this one is a slam dunk...

Good luck with it!!

Just fight it via written declaration. Worse thing that can happen is you end up paying the ticket. If you win, you're off the hook.

You think the state of CA would let $300 out of their grasp?

I went on a "ride along" with the CHP MAIT team many years ago. We got a call that a semi rolled on HWY 76. It was a loaded truck with oranges. We get to it and there it is, right in the middle of the orange groves @ the base of Palomar Mtn. I look in the cab and the driver's head is missing. We spent a coupla hours looking for the head along the roadway and in the adjacent bushes. We couldn't find it anywhere. Once the emt's removed his body, we found his head. He was sitting/laying on his own head. Now, if he were wearing his seatbelt...

OP~ Wear your friggen seatbelt! I don't care if you fight the ticket or not, but wear your seatbelt. It isn't worth it not to.

Don't know if it's enough to beat the ticket - but just might be enough to annoy the judge and citing officer..
