If a tune disables EGR or eliminates certain emissions-related CEL's, my understanding is that you're guaranteed to fail a smog test.
If a tune simply optimizes fueling and timing without throwing any CEL's, I don't see how it would even be possible for a smog technician to detect it.

I agree with it being voluntary. I've been pulled to the side for it when I had my FBO 4th gen camaro. My tags were also expired. Told them I was on my way home to get ready to go to work. The CHP officer backed me out and let me on my way. Didn't even glance at the tags. Although I would hate to imagine what would have happened should he decided to do an inspection himself.

I think they are collecting info on which cars fail the most or have ownership that never fixes factory deficiencies. C4's (maybe not the obd2 96) all seem like they are branded with Star Station inspection only rego renewals.

That very stop was within 200 yds from my house, voluntary my a$$. They towed 6 cars that day. I've seen them set up at least every three years at that same spot. It's just past a blind spot and once you see it then it's too late. They're mainly looking for rice rockets but some of us long tube guys sweat these things too.

I wonder if they're actually telling people that the inspection is voluntary and I have to think they are not - why would you waste your time if you knew it was voluntary? It's not like you benefit in any way.
With that in mind and the comments from the CHP on the video telling the OP he can't stand on the sidewalk, it is against federal law for a law officer to misrepresent his legal authority.

In fact, the minimum penalty is stated as a fine or 1 year imprisonment.

So, again IMO as a citizen, I think the officer overstepped his lawful authority with the "lawful order" and this should be reported to the local CHP detachment. See my earlier post reference "Deprivation of Rights Under Color of Law", TITLE 18, U.S.C., SECTION 242.Also, for the other worker who complained about being videotaped, not only is he in a public area where there is "no expectation of privacy" but I'm assuming (couldn't tell for sure from the video) he's a CA state employee performing his public duties! Bit of a laugher there!
