A buddy of mine got pulled over on his motorcycle about a year ago, and the officer didn't put his car in park. The car drove up and smashed his leg/knee between the bike and car. One of the pegs punctured his leg, and he had surgery that day. He's going to court soon, with a jury, and my question is:
What kind of settlment do you think he will get?

There's no way to tell... It all really depends on the jury and how sympathetic (or unsympathetic) they find your buddy. I was a juror on a sexual harassment case earlier this year - the plaintiff's lawyer asked for $1M. We found for her, but only awarder 16k. Yeah...that'll cover *maybe* 10% of her legal expenses... It basically came down to what we thought she "deserved" since she got the ruling on, essentially, a technicality of the written law.
In short, tell your buddy to hold off on buying the Ferrari until the money is IN THE BANK.
The worst the cop will get is negligence. It all depends on the severity of your friends wounds and the amount surgery, & rehabilitation required to make him whole. Is there any permanent disabilty? There is a lot to be considered in cases like this. I'm not a lawyer, and don't claim to be.
The city where he lives will be liable for his hospital bills. What ever settlement there will be will have to be worked out with the attorneys, and the jury.
Bet it settles B4 trial, even if it's supposed to start today-Cities have alot more $ and insurance than we do.People (jurors) are alot more sympathetic with the injured especially when it involves Police neg. and they know it.

Someone here got center punched by the CHP. She was injured and the CHP admitted fault and offered her just about 0.
The State is the toughest to sue. They offered this woman $5,000.
A friend was driving on hiway 5 in the boonies and the car in front of him went off of the road. He parked on the shoulder to add the driver and as soon as he got out of his car a CHP cruzer smashed into his car.
Totaled it and he got a ticket for parking on the shoulder.
You can't beat the state. Your friend might get $15k.
Well the cop was totally at fault. This isn't the dispute, he broke 2 different codes, one being that all CHP when parking there car always must use the e brake.
The already offered him $50,000, but that barely covers medical bills. Now lawyer fees on top of that.
The guy/gal has a gun and a badge with the legal authority to shoot you. Nothing will come of it, he's fighting the system. He/she will most likely be held harmless.

The sad truth is, at least here in Wisconsin, the case would not be all that valuable becasue of governmental tort imunity. The amount the State/City can be held liable for is very limited if the officer is actiing within the scope of his duties. Here in WI the $50K would be the cap.
