Insurance company denies my hail claim....
#21
I live in an area with summertime hail storms....Ive never seen hail related damage like you show in your pictures. The scratches look like wear and tear.
My Vette was outside during the last big hail storm, and had 0 damage......My other vehicles werent so lucky.
Ill be surprised if you get anything more from the insurance company, other than a cancellation of your policy........Which will affect your ability to get coverage elsewhere and will affect the rates you pay.

does wind blow down? all the scratches in the pics are going downward at a slight angle not across
how come my cars that had hail damage never had scratches? is the paint on a c5 special?
insurance companies has no problem with paying for hail damage how much the pay is another story...

Your cars that had hail damage have body panels made of metal that dent when hit whereas C5s are made of SMC and thus bounce back when hit.

Insurance Co. point of view: http://claims-management.theclm.org/...something-else
Hail Damage vs. Mechanical Damage
Dents that are caused by natural hail typically vary in size, have shallow bottoms, and have very light creases across their widths. A hail-caused dent will be randomly located on a panel instead of arranged in a pattern in relation to other dents, and will not exhibit a scratch in its center. Natural hail is relatively soft and typically does not harm paint.
On the other hand, intentional or mechanically caused dents are created with a metal tool that is usually much harder than natural hail. As a result, marks made by a metal tool generally are uniform in size with sharp, crescent-shaped creases accompanied by a scratch in the paint.
When evaluating a dent, be aware of unintentional mechanical damage such as door dings, scratches, and pebble chips that result from normal wear. These imperfections are easily identified and typically exist where hail dents would not occur. A small amount of unintentional damage is to be expected, increasing with the age of the vehicle.

my cousin c5 like i said was in the same storm i was in cars was 50 ft apart he didnt have ANY damage and i had $4500 worth ON on top of my suv and one side MOST of it was on the top
even if this was from debris flying around no way every side would have been scratched unless he was in the eye of a tornado?

My point is, not all damage is necessarily from just ice. Just depends on the location of the vehicle at the time and the immediate surrounding area as well.

There is so much bad advice in this thread it's unreal...
#1...state laws vary on what your rights are in a first and third party claim, some states place a greater burden on an insurer than others
#2...You're talking about what you're going to say in court, it should never even get that far.
#3...Contact the insurance company and speak to a senior or supervisory level claims rep.
You could get this covered easy...all day...easy.

Just a thought for you, photos are worth a ton! Perhaps you could ask forum members for any photos that show like damage from like circumstances. If so, it may help your case. Not trying to insult anybody but I've had my share of go arounds with insurance companies for damage to cars and buildings on claims that were first denied and then approved by sticking to my guns and not folding. Last car issue, the Mrs hit a buck deer that come off a descending bank. Damage to front and roof. The insurance company advised they were going to pursue a criminal fraud complaint against me because of the roof issue and deny the claim. Called my lawyer who advised the insurance company that I had taken a roll of photo's at the accident scene before anything was moved. Photo's clearly showed deer hair stuck in the roof rack (Jeep Grand Cherokee Laredo) and the deer BEHIND the car dead in the road. The deer was struck, went into the air, landed on the roof and flipped off the back. They had been verbally informed of this but insisted I was trying to defraud the insurance company. I instructed my attorney to advise them that I will immediately pursue counter complaints for unlawful prosecution should they pursue their criminal complaint and to provide them with copies of the photo's. I received an IMMEDIATE apology and agreement to make the repairs. Should not have had to go through all that ******** but the photo's saved me an awful lot of trouble. I still keep cameras in my cars. Hope it works out and best wishes to you! Sorry, I feel compelled to add this. I claim no knowledge on the technical aspects of the circumstances/damage to your car. What I'm saying is that if you are honestly dead sure of the circumstances as you outlined and you can get some supporting information that substantiates said claim, then pursue your repair with the company. You paid your premiums and deserve the repair if all is as you stated. Take care and good luck!

The adjuster denied your claim? Call and speak to whoever he reports to and kindly explain the situation. You get more flies with honey, trying to sue them right off the bat isn't going to get you anywhere but it could make for an entertaining follow up thread.
