just work-out a fair retail price
do your homework
1.look at kbb,and other car value sites
2.ebay for what there going for
3.autotrader for what people are asking
4.print out 10-20 cars [all on the higher end]
5.you will probably be dealing with their insurance company,so you might want to get your insurance involved too
don't get mad and yell, this is business

You obviously know nothing about law, or litigation. I’m usually not a fan of frivolous law suits but in the OP’s case I think I’m game and it’s not frivolous. Anyway that being said he already laid out his claim for pain and suffering.... saved up for first outright purchase on his deam car and now it’s gone.....the worst ambulance chasing lawyer with an online degree could get him punitive damages, emotional stress....etc....

So sorry to see this, hopefully the dealership will do the standup thing and make this as right as possible for you. That being said, I don't believe it happened the way they have told you it did. My guess is someone at the dealership started it up, was revving the engine to hear how it sounded and their foot slipped off the clutch. First, as other's have said, there is no way that car started without someone depressing the clutch. Secondly, looking at the damage to your Corvette and the garage door it shot through, it doesn't look like it was just idling, I'm guessing someone's foot had been on the accelerator when reverse was engaged.

It was probably about as hard as I laughed when I saw that response from him.

Oh, you would, huh? And just how would you go about that? The car has "X" value, and that is the max he will get for it, if totaled. Tell us your secret to getting a $60K car to replace a damaged $20K car...

If the person was under the influence then I could pursue other problems than my car

There is no rush, though you should go over there with a witness and try to start the car in reverse without putting the clutch in. If it does not start, you will have a stronger case. Like I said, no rush...see what they offer to do. If it does not make you 100% WHOLE for the loss, turn them down, and tell them to try again. If they won't, then get an attorney. Keep in mind that you will be liable for all costs of pursuing the case, including attorney fees, witness costs, appraisal services, etc. Yes, your attorney should stipulate that all expenses be included in the award, but there is no guarantee that the court will agree.

The foot has to be on the brake too lol...He went clean through that garage door lol all the way and and by the looks of the wheel out into the grass probable over a curb... You can still see his *** crack pinched permanently in the leather seat bottom. Look at the floor mat..lol...He was doing some rodeo riding.

You need to take emotion out of this situation. They are probably lying, but it doesn’t really matter. The damages are the damages. The only question is are they willing to proactively do something extra to avoid reputational damage. I’m betting they do nothing else for you.
If you are thinking about a new car, this would be the time to ask for a sweetheart of a deal.
