It doesn't matter if the clutch switch was bad. You don't push the start button unless you are in the drivers seat, with doors closed, and the shifter in neutral.

So sorry to see this, hopefully the dealership will do the standup thing and make this as right as possible for you. That being said, I don't believe it happened the way they have told you it did. My guess is someone at the dealership started it up, was revving the engine to hear how it sounded and their foot slipped off the clutch. First, as other's have said, there is no way that car started without someone depressing the clutch. Secondly, looking at the damage to your Corvette and the garage door it shot through, it doesn't look like it was just idling, I'm guessing someone's foot had been on the accelerator when reverse was engaged.
Been there - seen it !

I don't understand all the hyperbole in this thread. Calling BS on the dealer story, car couldn't start without clutch engaged, lawyer-ing up and all. I didn't read all the posts but I didn't see anything about the body shop not taking responsibility. These things happen every day and just because your car is special to you, the incident isn't so special. It's a 2007 base unit. There are literally thousands of them across the country that would be a suitable replacement. Get your insurance company to do what you pay them for and you will soon have a check in hand and go out and grab one of the thousands of C6's out there and go on with your life. Don't overthink it. Or as they say.....Keep it Simple, etc.
No muss, no fuss, thats what you pay an insurance company for.
They can either make the body shop give you fair market value.....or they can pay you fair market value.
Swap out whatever addons you put in if you have the old parts (not supposed to do this but....).
Get another car.....

If the tech reached in to put up the window did he not reach through the window to put it up thereby he would have got caught in the window. If the tech was reaching through the passenger side window to put up either window they would have to have a freakishly long arm and then how did they expect to turn the vehicle off? Ifthe door was open and they reached in turn the ignition on why isn’t the door damaged backing through the garage door of the shop? Same if they were on the other side.
I,would suggest you get the vehicle out of the shop as quickly as possible to preserve the evidence. Hire a company to get into the EDR (black box) there is a lot of information that can be extracted from the EDR.
The shop should carry garage keeper liability insurance. So your insurance company will be able to Subro them for the damages. Also they will owe you diminished value if you can’t get them to total it. PM me if you want to discuss more.

The car was in their care, so they can claim on their own insurance, as long as you can get enough to buy a car the same, and you are made whole I would be happy with that

Even if the clutch switch was faulty who the hell starts a car in Rev without putting car into Neutral or placing foot on the clutch?
