He told me this week, My guess is he's going back and forth with Geico on the matter. Hope to hear something today or tomorrow.

What is the monetary limit of Small Claims court in your state? You could start there by filing a case against the transport company in small claims for water damage, representing yourself. (yeah, I know, "...a fool for a client" and all that, but what other option is there without spending $10k-$20k in legal fees?)

Then go after the original dealership in small claims for damages *they* inflicted to your car and then did NOT repair, etc.

Then go after Geico, not for a "total loss", but for "loss of value due to accident" that they had, by contract, agreed to cover, and then failed to perform.

You might have to go after each party individually to help cover your losses, dividing your total loss into smaller chunks, instead of just working towards one large total settlement (which appears unlikely, given the events you have portrayed)

Just a strategy to think about if nothing else works out.

I'm really hoping he gets some results! This whole situation is disturbing, and I'm sure a complete nightmare for you. It's not my car or insurance agency and it infuriates me at how's this whole mess has been handled.

Because all they mostly are is social media monitors that don't have much power to do anything. They mostly connect people to the same numbers you would call in the owners manual if you're having problems (at least that was my experience)

OP, I don't know what you're waiting for....you have a powerful friend with connections to the AG... USE IT!!!!

I can't think of any better person to lite a fire under the **** of all the people involved in this fiasco and get it resolved for you than the AG.

The Insurance Commish told me to wait to see what he can get out of Geico before talking to the AG. That is the next step. Just trying to take things one step at a time. That's the next step.

In California the small claims limit was $5000 IIRC. They also limit you to that amount for a few years. IIRC it was like a max of $10K for 3 years. This is to prevent those dudes who sue everybody often.

I really doubt it would be $10-$20K in lawyer fees.

I so want to throw up after reading all of this thread. Can only imagine your heart ache. And how the heck you've been able to keep posting about this here and responding to everybody (neg and pos) has got to be equally challenging too.

I'll wait for Monday and write our SC Congressmen (I'm in the Upstate) and other representatives if you need.

They are not going to total the car. They said they are only willing to pay for $12K for the damages that have been done to the vehicle. They are denying the fact that the car has had any water damage. They are saying that they are not responsible for the storage fees where the car has sat for the last month.

According to Geico's Senior VP of claims "that's not Geico's problem neither are any fees associated with finding or relocating the vehicle. "
