If you use Progressive Insurance, consider switching.
So as some of you might know last week my Vette was rear ended by a drunk uninsured motorist. Well I was just informed by progressive that because he didn't have insurance they're refusing to pay for diminished value to the car. I guess it's my fault that he didn't have insurance and I should pay out of pocket for his mistake.

OP - That sucks - I can imagine how I would feel. I hope you didn't assume they would voluntarily do the right thing? Of course they said no - They all do, at least in my conversations - its worth fighting for - hire someone to do the work if you don't feel like the hassle. If it was a 30k car I wouldn't mess with it - but this is sizable enough to go after it. It's a man eat man world out there. Go take a bite I don't know the legalities if what they said was true or not but I would sure find out and if theres one person to never trust its a person who is paid to keep claims as low as possible. Not saying he/she is a crook but don't take it at face value.

Not an issue in Georgia .. to sell insurance in Georgia not only do insurance companies have to pay Diminished value claims ... they actually do it without you having to ask ... an extra check just shows up in addition to the check for the actual repairs. I think I got about $1200 when somebody hit my Focus ST in a parking lot last year.

Progressive is a horrible company and I wouldn't do business with them, or trust them to insure anything of mine, regardless of how cheap their rates are. I've been screwed by them in the past too...and don't even get me started on their political contributions.

I have had lots of friends and family get screwed over by Progressive. I have been with State Farm since I was 16 and have been very happy. USAA could not even beat their coverage for me.

Had Progressive for years and found them to be excellent. George Soros survived the ****s in WWII and is a very successful businessman. Thought people liked successfully business people?

Uninsured motorist insurance is subject to diminished value in a handful of states. If you were in Oregon, per your profile, that is one of them. You should read the language in your policy, however the Oregon summary of coverage states that uninsured motorist coverage should pay for everything that the other party's insurance would have paid for (which would include DV).
I've heard all kinds of stories where insurance companies try to deny DV claims, often wrongly. These lower level adjusters probably don't see it much and aren't as familiar with how it should work. If it isn't clearly in or out in your policy, I would start with a call to the Oregon Insurance Commission Consumer Advocacy line — 503-947-7984 or 888-877-4894 and see what they tell you, and file a complaint if you have to. Next step would could be a lawyer or a DV specialist, but I suspect you'll get somewhere with the insurance commission for free.

OP. The member advising you to contact the state was dead on. This way it's resolved and good thread to open people's eyes to wjat these big companies are doing to the little guy!

Last time I looked, there is no such thing as "Diminished Value" for insurance in Illinois, so you don't have to worry about who will pay. It's always you.

Diminished value as a concept is valid in all states, although Michigan's no-fault laws make it hard to really applicable.
Here is a member in Illinois who was offered a (laugable) DV settlement back in 2009. Too bad he never posted any outcome.

I have my own reasons for dropping Progressive, and likely will never go to them again.
But I have similar feelings about a lot of insurance companies.
