Case #2 is what happened guys. Just spoke with the service manager and he assured me he was the one that had to drive it those amount of miles on several trips to try and get the monitors cleared so it would pass the NYS inspection. He was adamant that he was not hammering the car and only drove it because of the issues brought on while updating the software. He was very apologetic about the lack of communication as he thought the service adviser was keeping me posted. Im taking him for his word that what he said is actually what happened. I love the car how it rides now. I only asked for an oil change since they left my car on empty and he agreed to that. Thanks for all the advice, especially ATLJAR.

Did you take it in for more than the mag ride software update? What exactly did you request in writing and authorize with your signature on the repair order? Did you say you were going for the state inspection directly after you picked it up?

The answer is to always go far above them. The dealership will deny it.
But locate the regional manager who will be surprised and hopefully get involved.
If not, go higher yet.

Let it go guys. The op was given a logical explaination from the service manager. I don't think a polygraph is necessary and he isn't getting a new car.

More so, a scripted and rehearsed explanation that every dealer will use in the event that someone caught them joyriding their car that almost sounds believable. Dealers will do and say anything to get out of liability. Just like a cop will do and say anything just to get you to implicate or incriminate yourself.

If @97Black had asked only for the mag ride upgrade, the driving would not have been necessary. If the dealership had done the inspection before applying the mag ride update, it would have worked. If they had done the job properly (with battery on charger during the update), it should have immediately passed the state inspection.
Actually, the dealer's (tech's) incompetence is partly to blame here. It should not have been necessary to drive it to get it to pass inspection. I would still be "somewhat dissatisified" with that experience, and I'd let GM know about it on the survey (if the mag ride update was covered by warranty or customer courtesy according to some TSB. But it sounds like the service manager drove it (gently we hope) to get it to pass the inspection which was requested on the repair order.
If it's possible to retrieve any logs in the thing, you could check for abuse by taking it to a differentdealership and having them check for active handling events, traction control events and other recorded evidence of abuse. I'm not sure I'd pay for the diagnostic time to get that if everything seems to be working as it should be with that explanation from the service manager. Still, I would find another dealer to service my car in the future.

And a GM drive cycle can be accomplished in about 30 miles, but quite often it takes 2-3 drive cycles to get the monitors to set. So the explanation is possibly true. However I am astounded that they didn't call you to get your permission to put even the first 30 miles on the car.

I'm not surprised at the dealer's explanation given what you bring back from him, simply, he should have warned you that the update requires a road test and that it may take time. I don't think he jumped 80 mid of a leap but only step by step to follow the update. These guys sell these cars every day, they know them.
Tell me about the valet mode, I have the PDR : should I put a code to use it in this mode ? I tried the valet mode but it doesn't register. Thank you

West Herr got too big for their own good. Owners are detached from reality, and all they care about is volume. I used to go there - now there's not enough money on the face of the planet to get me to go back. I feel sorry for you - given what I've had to put up there, their inept service team, lazy sales team - I'd honestly bet someone took it for a joy ride. Id keep complaining all the way up till you get a call from Scott Bieler...then never go back.
It's not too far - but Van Bortel Chevy in Rochester is a solid spot. IMO prices are a bit steep, but a hell of a lot more trustworthy than West Herr.

Many years ago I had a '88 Dodge Daytona Shelby. Took it into the dealer because the stereo quit. No such thing as valet mode back then, so I popped the vacume line off of the waste gate before dropping it off.
