Update: The title search just revealed that the property is a mini-subdivision and the easement will stand were it is because that is the way it was drawn up.. The Lawyer called the previous owner and he is going to build 2 houses on the back parcels for his sons.. Back to square 1..... Realtor is writing up a release to get us out of the commitment and refund our deposit.. Once again thanks for all the help!

He doesn't know the bank is going to foreclose on them?

No, it seems it was was a total of 9 acres and he sub divided it into 3 lots. 7 acres and two 1 acre lots.. Then he mortgaged the 7 acres to build his house and that was foreclosed on. The smaller 2 lots , I assume weren't in the foreclosure. It looks like he was going to make it a family compound of sorts.
