It's irrelevant when it comes to legislative intent. What matters is what they meant and based on the facts of the time, they obviously did NOT mean to give constitutional rights to the unborn. The policy at the time was that killing the unborn before 15 to 22 weeks was 100% legal without due process, so they could not have meant to give constitutional rights to it.. Legally, that's ALL that matters. Legislative intent can be established.

Finally, the little embryo was was less than 3" tall on screen, I asked how big that was in reality and the doctor said "that's 100% scaling, what you are seeing is the size of the baby'. He was not much bigger than a peanut in the shell at that point, yet was demonstrating movement that any parent would later recognize as authentic to his later behavior. (any parent except Sifu-TZ, who would need to ask the doctor if that behavior was recognizable).

Sounds like around 12 weeks.
