The OP getting written up for 5 over is BS, and hopefully will get thrown out. The cop should have written him up for what he thought was happening (and justified it in court) or let him go.

Plead not guilty to both and go to traffic court. They should throw out the ridiculous speeding ticket and smack you for the tint. You may want to remove the tint before your court date and they may throw that out too. Cops don't like tint. I don't blame them!:nono:

Yeah I'm sure you're always driving under the speed limit. I can guarantee you that the next time you get on your car YOU will break the law by being 1-5mph over the speed limit.

If I was going 80 or 90 in a 65 then I get your point.

And I'm not looking for sympathy, I'm looking for advice on people that have gotten BS tickets were cops are simply trying to fill their quotas.

The above section is for a Doctors note for drivers with eye problems only. For all others it refers to the Section 26708.2.

Sun Screening Devices: Requirements

26708.2. Sun screening devices permitted by paragraph (10) of subdivision (b) of Section 26708 shall meet the following requirements:


(a) The devices shall be held in place by means allowing ready removal from the window area, such as a frame, a rigid material with temporary fasteners, or a flexible roller shade.

(b) Devices utilizing transparent material shall be green, gray, or a neutral smoke in color and shall have a luminous transmittance of not less than 35 percent.

(c) Devices utilizing nontransparent louvers or other alternating patterns of opaque and open sections shall have an essentially uniform pattern over the entire surface, except for framing and supports. At least 35 percent of the device area shall be open and no individual louver or opaque section shall have a projected vertical dimension exceeding 3/16 inch.

(d) The devices shall not have a reflective quality exceeding 35 percent on either the inner or outer surface.

Tints - you are beat, just pay the ticket. If you are ever stopped at night turn on the interior lights before the officer approaches your car, this will help to put them at ease. As for the 5 over you should be able to reduce it to a non point ticket. They only want your money.

You know it's illegal to tint in your state and you still do it. You were speeding (obviously). And you want to fight it? Put your big boy pants on and pay up.

I speed all the time, but when stopped I don't come here complaining that I got a ticket for speeding. Five over is speeding in any jurisdiction. Do most people get tickets for 5 over, no, but I'm guessing that the OP was going faster than 5 over.

I know here in Florida that cops certified to run radar are also trained to judge speed without using a radar gun, as part of their certification.

Take responsibility and move on, but it's California.

I called it silence since you responded to posts on either side of mine. It appears you were speeding based on the cops statement, but only you know 100%. The cop didn't have an exact so he wrote it for five over. Maybe in the future he will write it as careless.....

And for the record, yes, I do speed, all the time, and I know that five over or twenty over, I'm still speeding. Call it revenue collection or whatever you'd like to justify the situation in your mind, but I'd say you were wrong and got caught.

When you go to court, please let us know what happens. Maybe you'll get lucky and the cop won't show.

My advice as stated before is to man up, take responsibility for your actions; any other response supporting you view is as pathetic as your original question. If you were wrongly cited I can see that but you weren't, you were breaking the law end of story. Looking for advice on how to avoid penalties says alot about you and your mentality towards owning your actions......
