I've always wondered, would I be better off holding position and letting them hit me, rather than taking the ditch and avoiding them hitting me?

If they hit me in my lane fault is more easily assigned.

If I take the ditch, and prevent our cars from impacting, it is hard to prove they contributed at all to what is seen as a single car accident.

Also, ditch damage can be very damaging to a car, potentially more than a sideswipe.

yeah depending on the situation, braking and turning in to an unavoidable accident might be safer, at least for you, but not the recipient of the pit maneuver

Bummer, no how you feel, back in November someone ran me off the road at night into swell, car hit at 80 MPH went down, and then airborne bottom of the car $3,500.00 worth of damage according to Bodyshop.
I will say they pulled front bumper, underneath was scraped and pure white, from the scrape, air dam gone bracket broken coolant leak, and much more.
I have to say the bodyshop not that I wasn't counting took them 9 working days to give my car back better then new.
So I know how you are feeling!!!!!!!!

Excellent point, something similar happened to me, I swerved to avoid someone and hit a curb, my insurance said it was my fault, failure to maintain control.

I should have let them hit me, but human instinct kicks in and you try to avoid being hit.

I have been thinking about getting a dash cam for that reason as well. It's unreal how some people drive.

I was driving to Executive Board Meeting at our Union Hall Friday afternoon. I just got into the LH Turn lane driving about 25 MPH when all of a sudden i see a lexus suv all of a sudden decide he wants to go left also. He literally drove me into on coming traffic, my horn blaring, he just kept going. Pushed me completely into west bound traffic. I got out of the car real quick to avoid getting plowed into head on. Once people started to show up he started to try and blame me for driving crazy and cutting him off. Luckily, there was an Attorney driving right behind me and saw the whole thing. He quickly jumped into action and advised me to not say another word until Police arrived. This accident happened in China Town here in Vegas and i was shocked how all of a sudden the Asian Driver had multiple Asian witness show up and claim they saw the whole thing and i was driving crazy. OMG!!! Liars. When Metro Police arrived they bombarded him with accusations. Thank God the officer knew how to read a accident scene. He immediately shut them down and said "Let me guess, since he is a young man in a Corvette it must be his fault" My NEWLY hired Attorney had a dash cam, the Officer watched it. He sprung into action taking "Witnesses" ID's and telling them they will get a citation for giving false statements. They all Quickly recanted there stories. One of the "Witness" got a citation for false statements. Turns out it was the guys Son in Law who he called to the scene. The driver recvd. multiple citations also. JUSTICE!!! I will be purchasing a dash cam TODAY! The Corvette arrived at body shop yesterday. Keep you guys updated.

Lets just hope the lad that hit you has Good insurances, since between the repair cost, and the value deflation for the wreck on the vet that lowered its resale value even after the repair, it going to get spendy real quick.
