Default CF Vendor Dispute - PTS Wheels, Perry Price

I take no pride or comfort in alerting my fellow CF Members to a matter of non-performance, non-delivery with PTS Wheels out of Roswell, NM and represented here on the forum by Mr Perry Price.

The straight, narrow and truthful facts of my transaction are as follows:

Early January 2012 I settled on purchasing Nutek wheels via CF Vendor PTS, with representation by owner, Mr Perry Price. Decision came as a result of PTS advertising and posting on CF

1/11/12 - I was invoiced by PTS wheels for a 50% deposit on my set of Nutek wheels - thousands of dollars. Build was to take 4 weeks and delivery to me would follow immediately. PTS was also to sell me tires, pmts sensors, lug nuts, locks,mounting and balancing, with additional invoicing for the same to come.

1/12/12 Paid the 50% deposit in full via PayPal funded with my credit card.

1 week later another wheel manufacturer that PTS represents posted a thread on CF inviting customers of PTS to contact them directly as they had suspicions that orders for their wheels were not being submitted by Mr Price. I emailed and telephoned (copies & records) Mr Price regarding this posting. Mr Price assured me that the manufacturer was out of line - there was 1 single issue that had been resolved and had nothing to do with Mr Price's non-submittal or orders.

Over the next 2 to 3 weeks had email (copies) and telephone (records) communications with Perry Price about the status of my wheels, tire options, etc. Perry promised me photos of my wheels in production. He had a gentleman at Nutek who was personally handling my order. I would get progress photos and updates.

The photos never arrived. The promised progress reports never came. I left Perry Price voice mail and email messages as to their status (copies & records). No replies or vague additional promises.

Week 4 arrived. Wheels should be completed. I was excited with anticipation, yet in my gut was nervous. Always listen to your gut. Emailed Mr Price seeking delivery info - no reply. Tried telephoning Mr Price at both his business and cell phone numbers - phones disconnected. PANIC.& FEAR ensued. (copies & records)

Having no clear alternative I desperately contacted Nutek Wheels by phone. Office was closed for the day but I was assured I would be contacted the next morning by their Sales Manager. Next morning I was indeed telephoned by their Sales Manager as promised. I introduced my self, explained my situation, my 50% deposit payment and inquired how I could make arrangements for shipping directly to me by paying balance. The other shoe dropped. I was advised by Nutek Wheels that they had no order or funds from Mr Price for wheels for me. They in fact had no idea what I was talking about. The only thing they knew at that minute was that they too had discovered Mr Prices phones disconnected when trying to reach him on another matter. They asked for a bit of time to investigate and call me back.

Apparently I was not alone. Nutek did call back. Without sharing more detail than they could they advised that I most likely had a legit concern with Mr. Price & PTS. They naturally could not be held financially accountable as PTS is an independent business and they had no involvement - I certainly understood their position. They offered anything they could do to assist me, they would. They were most compassionate and understanding.

I opened a detailed Dispute Claim with PayPal. I open a detailed Dispute Claim with my credit card company. I wrote to 3 Moderators at CF and advised the situation in confidence. I continued to attempt contact with PTS to no avail.

PayPal contacted PTS regarding the Dispute. PTS advises that Nutek is the 'problem' as they did not honor some warranty commitment so PTS was holding my order. We spoke with Nutek - there is no open warranty issue. Why was my order not submitted as promised? Nothing.

CF Administrator contacts me and asks if I would like his involvement. Turns out another CF member is having a 'similar issue'. I invite his assistance.

Mr Price then claims on his dispute narrative to PayPal that the reason my order was not submitted to Nukek was because Nutek would not accept his credit card. As wheel manufacturers do not accept credit cards from their distributors, no one could understand??? What about the claimed wheels in production process photos - what about the promised delivery date - how could either be possible if no order had even been submitted? No response.

CF Administrator is contacted by Mr Price who now advises he has refunded my monies and is doing the same with the other CF member.

Mr Price finally does provide PayPal refund for my monies. His check bounces. I have no refund. Refund to other CF never materializes.

My credit card company together with PayPal determine absolute non-performance non-delivery by PTS and reimburse my deposit from the PayPal Protection Program. I am reimbursed financially but am in no way whole, considering the time, effort, energy and emotion invested in this process.

I now 'discover' 2 additional CF members who are currently promised either refunds or wheels by PTS - both are far overdue. It is not mine to list the names or detail for the others. They can add to this thread if they want their experience listed. However now learning there are even others, I feel finally compelled to address the matter in the CF for the possible benefit of my experience.

This matter has consumed better than 2 months of my time. Wheels are no small investment thus honestly and integrity are paramount to the process. I have been provided neither in this matter.

There are the facts as I have presented them here to the best of my ability and recollection. I have the telephone and email records to back-up my statements. I have no desire to demean or defame anyone including Mr Perry Price and PTS. Perhaps my transaction and dealing was unique. I don't personally believe that to be the case but it is up to each to make their own judgement.

Just unbelievable. So sorry to read all you went through. I thank you for posting your experience. Fortunately you had a PayPal/CC process to help get your funds back, but as noted that is just a part of what you lost. I have PTS Wheels now on my Do Not Call list, and again, thank you!

I've discussed a similar issue involving user "Bad_AX" and have encouraged him to post a feedback thread giving a factual account of his issue.

I've been given the user IDs of three others who may also be experiencing similar issues. If there are others, please send me a PM with your situation.

Meanwhile, I've disabled the vendor's posting privileges to prevent the sale of further wheels until these issues can be addressed. He is still able to send and receive PMs.

If the vendor would like to add his version of the facts to this thread, he is welcome to contact me with his response.
