Default TPS Motorsports [dispute]

We purchased a set of Z06 brakes and Calipers from this Guy Mike Mak at TPS, WWW.TPSMOTORSPORTS.COM about 4 months ago. He starts calling all the other products out there inferior, terrible and over priced. Says he can give us a set at a great price and a $300 CORE Exchange.

Mind you we are building a Custom SS Vette which is still ongoing. We were in touch with Mike about the build and we spoke to Mike via email about returning the Calipers a few weeks ago which was 4 months after the purchase and we understand that. Mike had agreed to this as he was aware of our build and just said send them back.

In the meantime he goes on to try to talk trash about us saying we were trying to pull one over on him, he doesn't have room for anymore CORES etc etc and writes all sorts of stuff about us being a bad customer.

Once we show him the proof of him saying we can send the Calipers back and that he was aware of them being delayed several months, he deletes all his BS and NONSENSE posts.

This is where it gets better,

Our shop doing the install sends the brackets and calipers back to Mike, again our performance shop which is one of the top tuners on the east coast and has done this hundreds of times and Mike claims there is damage on the logs damage on the pistons, YADA YADA YADA.

Our shop says have Mike give them a call or vice versa but Mike goes into a tantrum and says we aren't dealing with them he sent us broken CORES and all this other stuff while calling them IDIOTS AND MORONS. I respectfully asked that he get in touch with them to which he hangs up the phone on us.

So instead of the $300 CORE he claims he can only do $150 so our shop tells us thats no good, we will pay for him to ship them back to us and honor your CORE charge. To this Mike immediately stumbles again on his words and says, check was already sent for $150 and we aren't going to send it back to you its been taken apart and all this other BS.

So you judge for yourself whom you want to give your money to here on this forum. I can tell you for sure I have dealt with many dealers on this forum and NEVER ONCE have I dealt with such a Immature, Unprofessional, and disresptful Vendor.

IF YOU WANT MORE INFORMATION OR WANT ME TO POST MORE TRUTHS EVEN THOUGH HE IS TRYING TO CLAIM WE ARE A BAD CUSTOMER BECAUSE WE WANTED WHAT WAS PROMISED LET ME KNOW!!!!


Here's the pictures that Mike claims were from our CORES returned. If indeed this was from shipping without packing material which again is what Mike claims, the shop that sent them to Mike offered to pay TPS to ship back and honor our CORE CHARGE.

BUT BUT, MIKE ALL OF A SUDDEN SAYS, TOO LATE CHECK IS IN THE MAIL FOR $150, EVEN THOUGH IT WAS 2 HOURS EARLIER HE CAME UP WITH THIS FIGURE. IF IT WAS A SHIPPING MISHAP OUR SHOP AGREED TO HANDLE IT, BUT MIKE WOULDN"T EVEN TALK TO THEM INSTEAD CALLING THEM MORONIC AND IDIOTIC, HOWS THAT FOR PROFESSIONALISM.

YOU GUYS BUY FROM WHOM YOU WISH!!!

HE CALLS US A NIGHTMARE CUSTOMER, LOL, I SAY ABSOLUTELY!!!

Gerry, we have returned hundreds of cores over the years to the largest brake distributors in the business and although I applogize if there was a lack of packing material, but this has NEVER once been an issue. They are cores, they are normally damaged as that is why they are replaced in the first place from most cars. A company is supposed to rebuild them and clean them up as needed, before selling. unless there was detailed instructions on how to return(which we never received) then this seller is not following the normal protocol. Any issues and let me know and I will call them. Once again, I apologize, but this is a very unreasonable allegation on a core return

I am going to post every email you have sent and upload the voice mail you just left so everyone can hear what your accusing me of. Here are the facts after our agreement. BTW, I cut your check already and the mail man picked it up. The calipers have already been taken apart and parts we can keep we're keeping the others we're scrapping.

#1-Your mechanic sent back the calipers and brackets with ZERO packaging and they caused damage which couldn't be fixed.

#2-Your moronic mechanic says it's normal for the calipers to be damaged like that. That is like saying curb rash for wheels is normal wear and tear.
#3-You look through my core refund policy and actually tell me that it's doesn't say the cores need to be non-damaged? Are you freaking kidding me? You really must be desperate for the $300 and obviously your degree in biochemistry hasn't done you any good.

#4-You tell me over the phone that the damaged cores is a problem I have to deal with your mechanic.... why the hell should I deal with your mechanic when he screwed up? You said it wasn't your problem and it was mine and his and your caught in the middle..

#5-You say I'm rude and unprofessional... wow that's amazing coming from some one who has tried to side step responsibility.

I'm tired of your games and accusations. What don't you understand about what happend??!? Your mechanic sent me damaged items and you want the full core refund? Give me a break...

A refund will be mailed out to you tomorrow. I can no longer process your refund through Paypal because you took so long to send the calipers back. Paypal has a 90 day limit as to if you can refund a transaction.

As I have stated to you the calipers were shipped back to us with ZERO packaging and because of that they were damaged to the point where some of the parts had to be replaced. For some odd reason you and the shop believe the damage didn't occur and it's normal wear and tear. Well it's not normal wear and tear and no one who sees those pictures will agree with you.

I have NEVER thrown tantrums and honestly what would you like me to call people who INSIST that the calipers you posted above ARE normal... NO ONE WOULD AGREE WITH YOU! That's why other in Vendor section people said you are WRONG.

I have told you when you were 1st notified about the bad calipers we were going to try and salvage what we can so we can give you some of your core money back. You asked for a check and I signed it and mailed it because I'm sick and tired of dealing with your drama and BS. Yes I told you it would be cut a day later... does that mean I'm not allowed to cut it early and mail it out sooner?

#1-You emailed me 6 months after you receiving the brakes asking if I could take them back. When I told you no I would not you basiclly went nuts. After tons of BS with you and over 100 emails with threats from you of lawsuits, calling the CA Attorney General, etc, tons of name calling.. then ALL of a sudden after days of BS from you you say you have proof of a email that you are going to expose me as the thief I am. I ask you to provide this proof and you say no your not going to do it and refuse to. So you DRAG this issue out longer and ALL I keep asking you is provide proof and you keep saying no and said you always had this email. So if you really had this email from the get go why not give it to me and the issue would have been solved and avoided.

#2-I refuse to talk to your mechanic because I dealt with you regarding the transaction. PLUS you kept telling me it was a problem with me and your mechanic and not your problem... why is it MY problem when it's your mechanic who shipped the parts back to me without packing and had the calipers damaged? AND why would I waste my time talking to people who believe the calipers they send me was just wear and tear even though the product was damaged because of lack of packaging.

#3-Sorry I misspelled nightmare. You obviously are such an idiot that you cannot realize it was a typo at Nightamre. This is a perfect example of how petty you are and have been.

#4-You did not initially ask us to reject the calipers. In fact, you were all upset about the possibility of losing the $300 core charge.

#5-Calipers are taken apart to see if we can fix them... I told you in the beginning we're going to try and fix them and asses what core value we can give back.

#6-I cut the $150 back to you once you sent me the email to send you the $150 core... I don't have time with your games of send back the cores, ok I will take the $150, then now you won't and want to tear up the check.... do as you please as the calipers are dissembled and your $150 core refund has been sent to you as per your request.

You really are clueless aren't you? You guys send me back damaged calipers, you acknowledge the your shop screwed up AND now you are arguing whether you really sent back bad calipers? That god your not a lawyer because you would loose every case because you can't get your facts straight. In fact, you waffle more on things than Obama.

This issue is closed... you accepted the $150 refund and I sent it to you... if you chose to destroy the check that's your issue and problem. I've done my part. If you wanted to ensure you receive the $300 back you should have made sure your mechanic packaged the products as that... it's that simple.

The logo damage is from normal wear and tear most likely not shipping. As our mechanic stated cores are completely rebuilt and he has done numerous sets and shipped without a problem. If there's a problem he will discuss with you directly. I will be providing his contact information so you can talk to him about it. He did not see anything noted on your website regarding this and would like to handle with you directly if there is a problem with the CORE refund.

You would think that if someone sends you bad cores they would accept responsibility BUT he tries to force me to deal with his mechanic saying over the phone "This is between you and him.. I'm just caught in the middle"

He also tells me that nothing on my website states that cores cannot be sent back in damaged condition which is absurd.

Who ever packed the calipers did a HORRIBLE job of packing the calipers.. they did not use ANY packing material. I mean they used ZERO packing material so the calipers got banged around. There's no damage to the brackets but the logo got chipped and so did the pistons. Here are the pictures of what happened to them. I will have to see if we can salvage these things. The brackets and rear calipers are fine but the front calipers got chipped and the pistons got damaged and will have to be replaced.
