Insurance Claim Question
My rear tires were bad before the accident and even though the one now reads zero pressure b/c of the accident the insurance company wont replace because they said they were already bald in the middle. My problem is I wont be able to drive it out of their body shop without having new tires put on... is this true that they shouldnt have to replace them and it my problem.. thanks for all help

I think we need more information. What kind of accident? Did the tires have anything to do with it? Does it read zero pressure because the tire is flat or because the sensor went bad during the wreck?
IMHO I would doubt most insurance companies are going to fork out extra dough for new tires when they were bad before any type of accident.

We could use a little more information as stated.
I can tell you being in the auto claims end of insurance that if they were bald before, they owe you what you had, nothing. If it is a slow leak from ? air it up and go straight to a tire shop. You may want to even flat bed it there so you don't have another accident. A high performance car with bad tires is a serious issue. The insurance only owes to put you back where you were before the accident, pre loss condition. If the tire was damaged in the loss they may measure and depreciate it's value, in this case still next to nothing.

Why would they buy you new tires when your tires were already shot? Maybe you can talk them into buying you a bald tire because that is what they owe you.

If they were bald in the middle, then I doubt that the insurance company is going to give you a new set of tires. You may just have to go out and buy a new set before you drive the car out of the body shop.

No more information needed... Geesh.. you have a wreck, possibly because or in part due to bald tires and you think the insurance company should buy you a new set of tires?
Why not sue the tire company for making crappy tires that go bald. You would have about the same chance of success in that endeavor.

You gotta read your policy. Its a contract and specifies what you get- and the exclusions. Ordinarily, the insurance carrier pays for replacement of parts damaged by a collision; and actual cash value or market value for a totaled vehicle. Most policies do not put the insured in a better position than he was in before the accident. If the car isn't totaled and the tires were not damaged from the collision or other incident, then you almost certainly wont get compensated for the tires. If the tires were damaged in the accident, , but arent worth sh__, then you"ll get compensated exactly that amount for the tires. Best to read your policy.

I would think if they were "kind" they might pay for a used replacement tire that just meets legal standards. Anyway, what good does one new tire do if the other 3 are nearly shot?

Riding on bald tires is a safety violation in every state. Under contributory negligence laws, you may be partially responsible for your accident. Get new tires.
