Default Hit and Run...sort of...

OK, Saturday day, my baby was hit by a fool driving their new truck. It was parked by a curb spot, and being a new truck, they didn't know their turn radius, and slammed into my car. My front bumper needs to be replaced (thankfully 95% of it is just on the bumper, and easy fix). Well, several co-workers saw this, and stopped the person. I was immediately told, and so I run out of Rockfish (waiter) in a blaze. The guy and wife are outside talknig to a fellow co-worker. Well, we get to talking, and the guy appologizes numerous times, and , of course says he doesn't want to go through his insurance, but would pay out of his pocket on the side...and what do I do...I believe the sob...I get down his number, address, name, etc., which all turns out to bogus...now who is the fool. The thing is, a waitress who noticed it was talking to the guys wife on the side, and found out they just bought it last Thursday...I can decribe the truck color, 4 door, tarp, etc..but no plate number... So, I called a local manager at FORD hoping to devulge information on a purchase, had to leave message. So, I'm sure due to legal ramifications, I will prob. not get the important purchase info...but worth a shot...tomorrow going to fill out the old police report...anyone have any other ideas??? What an idiot I am...goes to show, don't trust anyone!!!

File police report and report to your insurance. Also have police get statements from coworkers. If you find him, hang this SOB out to dry.

Always get driver's license and insurance card. You don't necessarily have to call his insurance but you'd have it as a backup.

Are you telling me you let this guy drive off with a handshake and got no info from him. You've got to be shiiting me.

i thought all Texans were stand up people. This sounds like what a Massahole would do.

Maybe you could hire a PI to track it down if the cost is worth it.

If I lived in TX I would do it cheap for em. Unfortunately I live in San Diego. Don't fret, you'll find the bastid.

YOU ARE SOL. Without a police report and license plate the day of the accident you do not have any recourse. The witnesses can not back you up because they also have no license plate number. The same thing happened to my wifes mercedes a couple of weeks ago. The guy wanted to take care of it on the side etc. AND WOULD NOT GIVE OUT HIS INFO. She was smart enough to call me and I said call police ASAP. Well guess what he was carrying a concealed weapon, started losing his temper, police almost arrested him. He also got a reckless driving citation mostly for shooting his mouth off. Chalk it up as an expensive lesson. Next time no matter who it is GET THEIR INFORMATION and remember a famous legal quote "MOST HUMANS HAVE SELECTIVE MEMORY- WHY DO YOU THINK WE NEED LAWYERS"!!!!!!

...and I did find him...went to file police report, and it turns out his info. was correct, but he mispelled his last name???...also, the street is brand new, thus, not listed on the internet etc. Yet, when I called his phone number, everytime it went to operator...well, I got directions from the cops and I went to his house. Turns out his phone lines were accidently cut during the construction of the new million dollar houses in the area. So, eitherway, now it's being resolved between me and him, but I'm still stupid for not gettin info...let that be a lesson, maybe you can trust people, but awlays act like you don't...

PLEASE do not resolve it between the two of you. You are compounding one error with another!!!!!!! You do not know this guy and have no business going to his house. Spells name wrong convenient but makes a good excuse for leaving, phone lines cut. Hey I have a 1953 Corvette for sale with 2 miles on it serial # 2. I'll give it to you for $500.00. I am being smart for a reason you have not learned your lesson yet. The next thing you will know is that he has filed a restraining order against you. LET THE PROFESSIONALS DO THEIR JOB!!!!! Call your insurance company, take pictures of the area and get statements from the witnesses. Now that you know who the guy is DO NOT CONTACT HIM ANY FURTHER!!!!!!!!!!!!

Joe, you are all of what 23? I feel for you because you speak with the simplicity of most people this age. I have been there done that etc. Let me tell you a similar story. When I was your age I had a brand new Mustang GT. A kid took the door off as I was getting out and then punched it. Well being 23 I wasn't going to let him get away with it. I chased him down and caught him- he was 18 and drunk out of his mind. When I got home I called the police (Joe this is when cell phones were for doctors only and came in boxes the size of a computer)and they refused to come because " I had gotten the info!!!! Next day the police show up at my door to shake me down and give me tickets the next day for reckless driving, speeding etc (after the fact) and the accident was charged to me!!!!!!!!!!!!!. Turns out he was the son of a local officer who was protecting his kid and insurance. Lucky for me my sister in laws father is a very famous personal litigator and a couple of phone calls from him turned everything around and even got the kids father reprimanded. If I did not know this attorney I would have been screwed!!! You are 23 and a waiter do not mess around with this guy you are way out of your league-get professional help, police your attorney etc.

I would let the insurance company handle it. If the guy is buying a million dollar house he can afford to let his insurance company take care of it.

If you go through the insurance company and during repairs they discover more that needs to be done your covered and they have a protocal as far as obtaining payment from the other party, if you settle on your own and he writes you a check and you go get your car fixed and then find that there are more repairs to be made you could end up being SOL and out of pocket.

Bracevette gives good advice...

Littlejake is right I did not even touch on that point. You have no idea of what it will cost to fix it. And if there are complications you will not be able to go after him again. People get so worked up over minor fender benders. In the end the repairs to my wifes mercedes only cost $273.00 not even enough to change his insurance rate; however because he was such a putz he got a 4 point reckless driving ticket which here in Florida equals huge insurance premium jump. Why won't this guy just report it to insurance? DUI, suspended license, restricted license. I hate to sound cynical but 43 years on this earth have shown me that many, (not all) people can be very strange and have many things to hide.
