I've got so many IM's it's easier to answer it all at once.
1. Vette is still in my garage and I still don't have the right to sell it. It's in mediation and until I solve this fight with Farmers (my insurance), I can't touch it. Once Farmers closes out, $$ plus I get the car, then the Vette goes back on E-Bay and goes to highest bidder.
2. My lawsuit with State Farm hasn't even started and is waiting on the Chiropractor's report which won't be for 3 plus months of muscle retraining. Once my lawyer has that we can go forth with property loss not covered by Farmer's plus of course the pain and suffering issues.
So bottom line I can't promise a date the car goes on sale but when Farmer's is done it goes as ONE PIECE, no parting off, sorry guys. Life's too short to spend months parting it out to make a measly extra $2000.00 or less.
Oh forgot one other good pice of info. Once my lawyer gets a complete package to file suit it may be a year till it goes to trial and up to 2 years before they have to settle. at this rate I'll be too old to drive a Vette by the time I get the money.
Fill me in on something. Are you saying that the lawyers/insurance for the chick who hit you have not even made an offer to settle or is your lawyer telling you to hold out? I don't know about how these things work, but I would have thought someone on the other side would like to see this go away. Maybe make you an offer of $50,000 plus any rehabilitation costs and everyone goes on with their lives. I hate lawyers & real estate agents(I just threw this one in) and will avoid them if it is at all possible. And... I even don't trust doctors at times that they are moral in their judgements of continually bringing you back again, again & again when you are supposedly cured. For some reason I see pocketbooks being padded.

It amazes me that S.F. has yet to contact me or my lawyer. We sent three letters to them and no response as of yet. The longer we wait the higher their costs will be. I have no doubt it will settle out of court and believe it or not I am willing to accept less $$$ to get this behind me and move on with my life.
As of right now the goal for July is to get the Vette off my property. Until I close out with farmers if I sold the Vette I could lose my rights to subjigation so it still sits there. I never wanted to get rid of a car as much as I want that Vette gone and "out of sight out of mind"

I just went through all of this. You will settle quicker if you settle out of court. I didn't want to take the insurance company's offer (which was almost two years after the accident) and got a court date that was another 8 months out. And this was in a small rural county in Oregon. Since going to court is such a gamble, I ended up taking their last offer, which really wasn't nearly enough. Your case sounds like it's a lot more cut and dried than mine was. Best of luck, the insurance companies don't settle like they use to. Wal-Mart lawyers have trained them to hold out until you die and you heirs die. I've seen people with broken bones only get low four digit settlements. You probably should of left the car in the body shop storage lot. After 6 months of storage fees they would have been happy to settle.

You know I read this and all I can feel is like someone, one of us, all of us should be petioning our congressional representatives to review and ammend laws governing the "fair practices" under which charlitans such as major insurance companies hide under. They have more liquid cash than oil companies and don't kid yourself if your payments aren't earning them crazy intrest (them not you). Then when it comes time to fulfill their part of the contract, their adjusters hide under a deluge of paperwork and string clients out to the 23rd hour to earn a large Christmas bonus for saving their company X amount of dollars. The whole thing makes me sick!
David, the unfortunate reality as is that insurance companies are 'for profit' businesses. They are out to make money. They offer to cover your losses for a monthly fee paid to them. That fee is based on how they rate your risk to them - the likelihood that they will have to pay out to you in the future.
When a situation arises that requires a payout, the insurance companies try to look for the least expensive way to cover the payout. That is usually a settlement and why most ambulance chasing attorney's tell you not to talk to the insurance company first.
In your case, you have 2 issues. If Farmer's is your company, they should pay out on the car, offer the buy back and you are out of the loop. Farmers then needs to contact the other party's company and have them reimburse what Farmers paid you - since you were not at fault. The issue may be that Farmers does not want to pay out until they are guaranteed reimbursement (a risk if they pay out first).
Second, as you are doing, you need to sue the other party for additional damage not covered by Farmers, and for the pain and suffering. That amout will be paid by the other partys insurance directly to you. That too, one would think, would be settled ASAP to keep costs down.
It is a risk assessment game and the insurance companies control the cards. Unfortunately, not having insurance would have been a worse scenario. You WILL get your money in time.
Best thing, IMHO, cover the car, and try to relax. Stressing yoursef out over this, while its good to vent is not good for your health and will not make things happen faster.
