After reading the suit looks like your screwed.I would at least expect SF to tell you why your car was totaled. If it was a theft recovery I would feel better than flood damage. As stated unless some lawyer can get you your money back for free you will not gain much with the cost to them.$5k is all your gonna get it looks like but demand the nature of the damage before you sign the papers.
If your not holding anything back (not telling the complete story) then you are in the drivers seat. A salvage title is worth at MOST 50% of value. State farm either should pay you the entire purchase price of the car plus fee for aggravation including tax and title fees, let them pay for your car plus the fees PLUS your attorneys fees...this is a no brainer....
HMMMM, that it an unfortunate problem you have. Sounds like you haven'ty put many miles on it so if problems exist from the damage/repair, they may not have surfaced yet. I'd be really pissed. But. . .maybe there's not much you can do about it, so look at it this way. . .you have $5000 tax-free to make whatever mods you've been dreaming of!
A guy walked into a bar and yelled "all lawyer's are a-holes".
One patron stood up and said, "I take offense to that comment".
The guy that said this asked, "Why, are you a lawyer?"
The patron said "no, I am an a-hole".
There was a voluntary settlement reached on this matter. I have not analyzed it fully, but you should read everything in that link and follow the other links.
Then I think it would be well worth your while to consult an attorney (even if you have to buy an hour of thier time) to make sure you understand your rights under the agreement.
Best of luck
I think some of my colleagues would look at this case, I would think that you could find an attorney in your area to review it for you. I would suggest one familiar with class action suits, good luck.
