Default Please Help I Got Ripped Off!!!!!!! ATRA

[PLEASE TAKE TIME TO READ] Wow I don’t know where to start. First off TimBVette if you can comment please do so. Well as some of you know I had paid $3,300 11 months ago to rebuild my tranny. Tim recommended a lot of things to put in the tranny and make sure they were part of the ATRA nation wide, and I did that’s why I paid soo much. Well 11 months / 9000 later the transmission goes out dead again. Well I found and awesome shop out here in Michigan Oniell’s the owner Ted is they guy helping me out. They took my receipt and said okay they are part of the ATRA so we will take care of you. They called my 2 days later and said I needed to come in so that we could talk. He told me and actually showed me what was really in the tranny. He said he would of charged maybe $1000 to $1200 for what came out of the tranny. Then Ted said that some spring on the converter was installed incorrectly so that caused everything to screw up. Everything that Tim told me to ask for I did and I got none of it . I also asked for a nice stall converter like a Vigilante The guy told me “oh yeah the converter I am going to put in is just as good” Well Ted at oniells said that it was about a $50 to $75 converter. So I got no 13 vane oil pump, kevlar band, rabestos "blue" racing clutches, kolene steels, "the beast" sunshell, 5 pinion planet, 29 roller sprag. They even went as far as not even installing a shift kit that they charged me for. The only thing the did install was a boost valve. So basically I really got ripped off and need to know what to do. So Tim and who ever else can help please give me some advise.

Here's what you need to do:

Get the F off the internet, call an attorney. File a complaint with your local Better Business Bureau (www.bbb.org). I hate to hear about this, man... Best of luck.

I feel for you man. I had an issue some time back with regards to work I thought I paid for only to find it not done. The only thing I can tell you is to get your facts together. Was anything that you mentioned written down? Do you have reciepts that state all the parts you were supposed to have or the work performed? If not your in a bad spot. I would also advise you to be cautious of what you air here on the boards, words can and do get twisted. I know your venting by posting this here though. I hope you can recoup your $ or get things fixed to the way you wanted. Good Luck.

Call an attorney and sue their *** off, from my experience BBB wont do anything.. have the guy that looked at your transmission document everything and take pics.

If the shop that did the work was part of ATRA why couldn't he go to ATRA and see what they can do? It seems like it would be worth the try.

First you must be true to yourself. If you stated the truth, with that type of cash on the table you should seek legal counsel.

At this point I have no reason to lie. It is all on the receipt as far as what work was done. So its a good thing I saved my receipt. Thanks to everyone that is giving me advice its greatly appreciated.

Ted @ Oneills is going to talk to that shop that did the initial work and the ATRA if need be.

Get the tranny shop to put it in writing-contact the old tranny shop and ask what they intend to do. Forget the attorney-find out what the limit is in small claims court in your area-it's very cheap to file in small claims court and-attorneys are not needed., you present your case and facts along with all documentation to the judge-and he/she makes
a decision.

You have the receipt from the orginal shop detailing all the work and parts they supposedly installed. Get 'Ted' to take pictures of what he found, as well as document it in writing -- have it notorized. Turn both over to an attorney and sue them. I would also contact the BBB to file a complaint; as dan6712 said, the won't help you much, but it might help it from happening to someone else.

Just kidding.... call the shop see what they got to say first. Next would be small claims here in Wa. it's $4,000 max claim check your local courts.

Good luck~ jeff

A lawyer gets $1500 just to write a letter. No exaggeratoin, $1500. This is a $3300 claim, and you can't sue for more than that. Unless the claim is up around $30K, lawyers are useless.

Small claims you will win, however try to get paid. You'll have to put a lean on his business, go to the sherriff, have them confiscate something of value, it goes to auction, then you get paid. They will take one item after another from his business until it is sold and you are paid back. A year later.

My cousin had to do this for a bad paintjob he got. Wound up with a 22 ft. searay in awful condition. Sold it for about $200 over what he was owed. He wasted allot of time.

He had to go to the auction to make sure that the selling bid was above what he was owed. He had to bid on it himself and buy it, then sell it for the money he was owed PLUS the auction price.

Good luck, let us know how it turns out.

Ugh! This is one of my greatest aggrevations. So from now on, I will be "standing right there" to watch the person assemble whatever it may be with my chosen parts.
