Default florida=the no fault state

30 days from taking my 85 with the new paint job to the U>P> of Michigan where there are more deer than cars, some moron with a W.V. license tries to park his dodge power wagon right up against the rear quarter panel and bumper...then even though it's clearly on video at the circle K with lots of witnessess, including me, he starts cursing at me, says he's not responsible because it's a no fault state....had to call the cops to calm him down..sorry, just venting.....some guy damages your vette, curses at you, and then laughs because his insurance isn't going to fix it. I have a conceal/carry and it was all I could do not to riddle his truck with 9 mm holes......cop says he knows him because he writes him speeding tickets....good to know.....be glad to be back in the U>P> where there are no snowbirds....just snow.....

I feel your pain. I quit carrying my 45 in the truck for fear of losing my temper and using it on one of the many idiots that drive around here.

That really sucks. But Michigan is also a no fault state. I can't understand why they have no fault insurance....it's more expensive for the average driver who *doesn't* cause accidents.

Do not know about Florida, but in New Jersey "no fault" only applies to personal injury claims, not property damage claims, as appear in your case. I suspect that this is true in most states. You may want to go after the guy, unless he has no liability insurance coverage.

you may be correct.....called his insurance..."star and shield"...never heard of them....filed a claim....they sent me to a body shop for a estimate...11oo bucks....haven't called me yet to say it's ok to get fixed...keeping my fingers crossed.....

I had a guy run a stop sign, ran right into the side of my work van..... and the police report said it's my fault. I guess because I was there?

Unfortunately even if the police report said you're 100% not at fault and the driver of the vehicle that hit you was given a ticket for running the stop sign you would still be at fault and can be sued by the diver and passengers because you were there. Ask me how I know!

Here in Michigan you can contact their insurance company (bypass the idiot) and force them to pay via a mini-tort claim. The Insurance company has to pay if they are at fault... and they will raise their premiums too or kick him off.

"Under Michigan’s mini tort law, victims of car accidents can recover a maximum of $1,000 for vehicle damage from the driver who caused the crash, via his automobile insurance company. This is called a mini tort claim."

When I lived in NY some idiot hit my rear bumper of my other car while stopped at a light. $700 damage. The cops came but he said I will pay you for the repair out of my pocket. He told the police that it was his fault. I said ok being nice a guy. Well he never paid me so I called his insurance co and told them what happened. He lied and told his insurance co. That I backed into him on a 4 lane road stopped at a light. No damage to his 15 year old POS. I got the police report and the idiot police officer never wrote that it was his fault. I called the police station and left 2 messages for him to call me which he never did. His insurance company would not pay anything based on the report so I had to pay out of my pocket. I still think about revenge . I learned my lesson the expensive way but I will never trust anyone.

good news!!! the morons insurance called and are cutting me a check to do the repairs....he objected but the video at the circle K tells all....never even called my insurance.....

so he transferred the damage from the front to the rear

It's important to always make sure the police are called and review the report before leaving. I recall in FL where I live it that the #1 on the police report identifies the at fault driver and the #2 is the victim. I was rear ended by a senile 94 year old lady who then tried to leave the scene. My truck had minimal damage and I felt fine at the time, but I insisted she stay and called the police. It's a good thing I did because about 1/2 hour later I couldn't hold up my head and my left arm turned into a monkey claw. I wound up having to have almost a year of therapy to address multiple herniated disks, but I recovered without surgery.

So not that the car is bad enough, but get the police report for your own health. If you don't have one and need medical care you have nothing. If you go to a lawyer, you have nothing.

Horrible about your car, sadly from what i have seen here in Florida, everyone in this state ( vette owners exempted of course ) seem to be bi-polar, literally ! And take road rage to a whole new level of insanity.

No matter what it is, you can be driving the speed limit on a sunny day and some a**hole feels the need to curse you out, cut you off or worse FOLLOW you to where ever you are going only to go into a blinding rage for no apparent reason. Ask me how i know!

Lived up north most of my life and NEVER saw anything as stupid as what goes on down here, mainly because if you are going to get into an argument, right or wrong it will end very badly real quick.

People seem to have an unrealistic delusional sense of entitlement which makes them think they can go on a tiraid about anything, everything and nothing; provoking life threatening confrontations with total strangers.

Considering how many people are actually armed and have their concealed permits, it's a miracle there aren't more murders here.

there are a lot of ccw's in fl....it's amazing there aren't more shootouts......there are a lot of shootings though......it's the seasonal exasperation with the traffic...people just don't know how to drive down here....just the simples rules....keeping left..yielding when going left...knowing it's not ok to just stop where you are if you don't know where you're going or make any turn from any lane at any time. also refusing to turn rt at a stop......I too grew up in the north....seems like most people know that up there.....here it's come to florida , drive any way you want....
