Default Over filled transmission

I purchased my car from a dealer that had the transmission serviced and it's overfilled now I have a leak back by the pan should I drain fluid and refill it to normal level I checked it when it was hot and it was above the full line is it normal to leak out when it's over filled??

Get a cheap suction pump and suck out the overfill.
