Default what would you do

it was dark no one on road besides my son an friends ahead of me in truck . my wife beside me in 2003 vette. suddenly cell rings son says dad pile of asphalt in your lane comming up. we are 25miles out on run to Tenn. 9hr. drive rod run in pidgen forge. i slow to 45 see rubble switch lanes to go around an hit pile just as big .. bamm hole big as fist in oil pan oil everywhere low oil pressuse lights up shut it down son an carry deck pick me up took pics is county liable? it was asphalt they been grinding up . im sick car only 7k miles not a scratch, worried it sent particals though motor. shut it down quick but?

I don't know 'cuz I don't know what you said.

One thing I wouldn't do is, use what you wrote to explain the situation to an insurance company.

engine should be ok(hoping for ya) ..........liability ? not sure. That is a major bummer, I would not be happy if it were me, I know that much. Good luck, hope it all works out ok

He hit a pile of asphalt rubble and put a hole in his oil pan. Is the county (road crew) liable?

If what you're saying is that the road tore up your oil pan due to road consctrucion, then I would have to make a phone call to the City and file a complaint as they could be liable for this. BTW, were there road signs indicating something like "Uneven pavement" or "Road Consctruction Ahead" or "Loose Gravel" or something along those lines? If not, then you stand a pretty good chance of having the city reimburse you for damages to the car. I believe this would fall under "Negligence" or maybe even "Gross Negligence." If they decline you, call up a lawyer and find out what can be done. They may or may not take your case!

In Florida, if a State dump truck drops rocks that damage the paint and you get the number on the truck, time, location and pictures of the damage, the State will pay for the damage (old co-worker did that with his TA). I don't know about road damage, though. I would contact the State DOT and find out what they have to say. Worst case, your insurance company should cover. Good luck!!

Hi 2pedala -

If there was fresh asphalt on the highway, that would indicate fresh work on the road - OR - an private company truck dropping it.

It would be hard to prove negligence (or even fault) unless you saw who dropped the stuff.

It is a repairable collision, and should be covered under your warranty.

I feel bad for you and your car - I would think that you shut it down in time to spare any serious damage - good luck buddy -

That's got to be the most cryptic I've seen in C5 Gen. Fairly common in C4 though. Even with my C4 experience, I still can't quite break the code. I was actually beginning to question my level of comprehension

Contact the state's DOT and see what they say. Also, let your insurance company know just in case. If there was no construction going on at that location, it would be iffy if the state would accept liability, but worth a shot. Hope you get the car fixed without having to spend a fortune out of your pocket.
