That's a great way to take something out of context. The post you reference was in response to someone...I think Zilla, who sarcastically suggested that one might sue the trucker as well....after he read my post that one typically sues the retailer and manufacturer in a product liability suit.
In no way can a reasonable, rational thinking person interpret this post as suggesting that the OP file a lawsuit. Sorry bud....nice try. This post was about the mechanics of a product liability suit and how one typically sues both the manufactuer and retailer....if they sue anyone at all.

Just admit that, contrary to your post I did not tell the OP to file a lawsuit, and also, admit that you spoke too soon when you told the OP that he would definitely lose a lawsuit if he filed one. The record would support these admissions and you can stop struggling here.

You can be 100% right and still lose in court. Been there done that. You can be 100% wrong and still win.
Lots of variables in court. The outcome is quite often driven by emotion rather then facts.
Did the judge have a bad or good experience with a Vette owner or the establishment in question? Who's got the deepest pockets? (one of my personal favorites).
This said my advise based on experience is only go to court as a LAST resort. The only ones that win 100% of the time are the Lawyers.

My wife is a lawyer and this thread reminds me of some of our debates. What have I learned over the past 14 years- a lawyer never needs to win a debate, just talk enough until it hurts your ears , at least I won the "Honey I am going to buy a Corvette today" debate.
