I was rear ended way back on the 14th. The guy that hit the 3 of us that were stopped at the light claimed his brakes did not work. He also claimed that he just left the shop where he got them serviced. Anyways, its been 11 days and allstate is still telling me that they are investigating the shop for the brake job. I think its a bunch of BS and I dont really know why they are stalling. The guy left the scene of the accident in his own car. I would think if the brakes did not work you wouldnt continue driving down the highway.

Anyways, anybody have and advice for me on this one. How can I pressure the insurance company to get a move on things. This is my first accident. Is it normal for it to take this long?

Oh yeah...it'll take awhile! I got rear ended in Dec and it was the end of July before all the bills were paid. My car was fixed by the end of January thanks to Burke Corvettes. Sorry for your misfortune!

Hopefully an insurance agent will chime in here...but I believe you can have your insurance company fix your car and then they can get reimbursed by the other person's insurance. Anyhow, if I were you, I would contact your insurance agent/company for advice.

This happened to my saturn and I only have liability on it so I cant have my insurance company fix it first. I have to wait for allstate. Its only a couple thousand dollars in damage but they are dragging their feet. I know it cant take more than 11 days to check some brakes to see if they were working proberly.

Is Allstate your insurance company or the perpetrator's company...or are they both? You should've had your insurance company process the claim on your behalf, as you should've been inconvenienced any further, but rather have had your vehicle repaired immediately...the logistics between your insurance company and that of the perp's should not be your problem.

Last year, one of our other vehicles was rear-ended at a stop sign by some 'bonehead' in a raised 4x4 who was yakking on his cellphone at the time of the accident. After obtaining the incident report number from the traffic officer, I immediately contacted my Allstate insurance agent. After taking some initial information, he then transferred me to the Allstate Claims Department. I gave that agent the incident report number and I was given an appointment to have the vehicle inspected by an adjuster at their local drive-in claims center. I told them the name of the auto body repair facility where I wanted our vehicle repaired, and we received a rental car that same day. Our vehicle was repaired to our satisfaction, and the entire process only took two weeks from the date of the accident.

I wish it went that smooth. It took them 11 days to get a look at my car. It isnt drivable and I left it at the body shop. I let allstate know the next day that it was there and waiting. Well 11 days later they finally look at it. Now I dont know I will have to wait before they finally admit fault.

Oh and I have Geico. The perp has allstate. Do you think it would be better if i called Geico and had them prssure Allstate too?

Get your insurance company involved and have them work for you - that's why you pay them. If nothing else, have them fix your car and then go after the other guy and his insurance company.

Allstate is Teh SUCK. I fired them. USAA Is much better if you qualify.

I was rear-ended last year. The person who hit me had Mercury, I was with Allstate. I had my choice to have either company handle it. I went with my carrier. I figured I paid them for insurance and that they'd look out for my interests better than Mercury would.

Still no money. I called Geico(my insurance) and since they have no financial interest in this situation they cant help me. Allstate said they are walking away from the claim and dumping it on the dealer that serviced his brakes. The dealer said they know nothing about it and if the claim goes thru them it will be a months long battle.

So the guy that hit me got front brake pads 2 days before the accident. Thats all that was serviced according to the service manager at the dealer. Now Allstate wont release any of the reports to me so I dont know anything on the job that was done by the dealer.

So anybody have any input on what I should do now? Do I have to get a lawyer?

Dr. DJ has the right idea. Call your insurance company and tell them you want to get the damage repaired. They will start the process. You will have to pay the deductable if Allstate hasn't gotten their act together by the time your car is done. Your company will them "subrogate" the claim. That means they will collect on your behalf and they will refund your deductable when they get paid by Allstate. If you don't want to put your deductable up front, you are going to have to wait for Allstate. If it were me, I'd start the process of getting the car repaired through your company and hope Allstate has their investigation done by the time your car is done. There is a chance there is another company involved and Allstate will try to sluff the claim off on them. If that's the case, the other company will have to investigage, too. They could possibly get in a pissing contest and leave you out to dry. That is why you ought to get your company to fix the car and let them collect for you. Their attorneys won't cost you extra. Well, unless you only have PL/PD (public liability/property damage) coverage, then it sounds as if Geico (your insurance company) is turning their back on you and not doing what you've been paying them for...acting on your behalf if/when you become involved in a vehicle accident. If this is the case, then I'd suggest looking for a more proactive insurance company, as this isn't the first time I've heard this about Geico. Unless you were injured and your vehicle sustained moderate damage, then retaining an attorney for such a case might prove to be costly, yet uneventful. Since your insurance company refuses to represent you in this case, you may consider pursuing this matter in small claims court, but only if the monetary damages you seek falls within your state's guidelines.

Have you thought about calling your STATE INSURANCE BOARD and getting them involved and have them look into the reasons you and the other guys insurance companys are holding your claim and repairs up ?They may be able to shed some light on the process and inquire about your claim!I left State Farm and Allstate manny years ago because they didn't look after my best intrests. I've been with FARM BUERAU in my state for over 25 years and have NEVER had any problems what so ever with ANY claim I've had whether it's the house or cars .They are THE BEST INSURANCE company I've delt with BAR NONE and they HANDLE EVERYTHING ,NO LEG WORK involved on your part!!!! They are VERY picky about who they Insure and driving records but the SERVICE you get is ABOVE EVERYONE ELSE !!!(JMHO)

Why is that? Im just curious.

My problem is I only have liability on the car(its my 99 saturn) so thats why Geico isnt helping. The agent that is working on my claim works in Buffalo and they are snowed out today so I have to wait to talk to her again. The damage was only $2,775.43ando it is within small claims court restrictions. If I do have to go that route who is the best party to go after?

Unfortunately, if you only carry liability, your insurance company has no financial interest in your claim & thus has no legal right to represent you. Your agent could make a phone call on your behalf but Allstate could & would tell him(her) to pound salt. Sorry about your situation but as far as I know small claims may be your best shot. I'd get some advice on this & probably go after the guy that hit you as well as the shop. Make sure you find out how small claims works before you try to file. If you file against the guy that hit you, Allstate will have to reply to the charges. Good luck.
