[Z06] Update Hood Cracking
Well call me a retard but I bought a car from a dealership. They did not disclose that the car had been wrecked. I did not notice that the hood and fender were misaligned. I went to an autobody shop to see about getting my hood fixed because of the cracking. The owner said that it the whole front passenger side is out of alignment and that is the reason the hood is cracking. They wouldnt even give me a price. He said to call the car dealership were I bought it which was CHAMPION DODGE in Greeley, Colorado. I have called them and asked why this vehicle accident wasn't reveled to me when i asked them.
What are my legal actions (if any) if the dealership doesnt make right?
Did you check CARFAX before or since you've discovered the prior damage? The damage may not even be revealed there.
Does your state law specifically state that a prior collision has to be disclosed to a potential buyer? It might only be a small box that got checked on the sales contract which might have been missed in the excitement of purchase.
Can you prove that dealership knew of the prior collision and withheld that information from you, intentionally? This could be the difference between a criminal fraud case vs a civil case.
Have you checked with the BBB or the State Attorney General for past consumer fraud complaints?
Does you state have a mediation board for complaints against dealerships?
You've spoken to the dealership, what is their response? This concern might be premature.
Does you state have a period of time in which to return a car due to circumstances such as this? Some states do and others don't...basically, you bought it and it's yours.
Many times a previous owner will have repairs made on the sly which doesn't get reported to CARFAX. The dealership might not have thoroughly checked out the car anymore than you did.
