Default Need to vent!!

Over a year ago now my 2004 coupe was hit by someone who ran a red light. It has since gone to arbitration because he claimed I ran the red. I got the decision today. Get this. It was decided that the other party did in deed run the red light. They determined that he is 80% responsible and I am 20% responsible for not stopping in time. Unfreaking believable. So I will only recover $800 of my $1000 deductible. I'm not a happy camper. Bright side is the car has been repaired and looks great.
Just wanted to vent.

This is the reason I don't carry a gun. Someone runs a red light, hits you, and you are 20% responsible for not stopping in time to miss him hitting you. Unreal.

My neighbor and I slapped mirrors on our trucks back in January. I knew it wasn't my fault as I was hugging the edge of the road and the tall grass was hitting the side of my truck. On his side of the road were everyone's mailboxes. After we stopped he came up to me and said I'm sorry I was trying to keep over and still not hit the mailboxes or me. There is plenty of room for two vehicles to pass but it was dark and raining. I knew it was a toss up with the insurance company since we both had the same carrier. Short story they said we were each 50% responsible so they got the deductible from both of us.

So the rest of the story. I see my neighbor about a month later a Lowes in the plumbing isle. He asks if I can help him find a fitting. Then he tells me, yea I got sick a couple of months ago and I have lost 80% of my vision!!! I feel for the guy but no mention of this in his conversation with the insurance company. Cost me $500.00

How can running a red light only be 80% at fault!!
The insurance industry lobbyists want 100% insurance so that the costs of all insured can be evenly distributed regardless of record, claims etc. That way it's easier for them to manage the costs and justify rate increases or "profit margin increases" as they should be called.

I'm afraid the days are gone where you can expect your premiums to go down as your car gets older and you have no moving violations.

These same industry lobbyists want more video monitoring, speed regulation, driving habit monitoring (aka Progressive's Snapshot) and black box accident detail.

Sometimes, the worst thing that can happen when you are involved in an accident is to find out that the other party has the same insurance provider. The insurance provider is going to pay either way, so you they will find the way that is easiest for them based on your deductables.

I had a similar situation as you mentioned when a truck loaded with scrap metal had fell from the truck bed and hit my wife's daily driver, we both had the same insurance and the insurance wanted me to pay the 500 dollar deduct....I said he'll no, why would pay when the other driver was ticketed for the accident.....she just replied ok and processed the claim...unbelievable! Sorry to hijack the thread

I've heard it all now. Surprised it's not 100 percent your fault for being there in the first place. That is BS. He ran the red light he is 100 percent responsible.

California is a no fault state, the accident explanation misses that crucial point. I add this so others might understand more completely. It is thought to be cheaper for the consumer than lawyers assigning fault.

To the good poster that launched the attack against California because of this guys insurance misfortune. Please don't.

It puts you in a bad light and offends the folks ,like me, who think differently. I like California and invite you to enjoy the states' many pleasures. Perhaps it will change your mind. Knocking folks at the flimsiest opportunities just because they hold different opinions is for talk radio, not for polite people sharing common interests. At least that is the general opinion around where I live. I trust Arizona is still polite. I regret having to correct anyone else's free speech, but thought the breakdown in civility important enough to mention . California is a good productive state, one of the major economic engines of the nation , and has good people living here.

As a shop steward at my company I often say, It's always a preventable crash in the company's opinion. After all you could have called in sick and you would not have been there. The sad thing is it's almost true. Someone can run a light and hit your truck. They will find something they think you did wrong and say you could have prevented it. It's a joke. They say green is not go it's proceed with caution. Well maybe but red definitely means stop and the other guy did not. The only one they ruled not preventable was when the other driver was arrested for DUI or the truck was parked.

I am from Kailfornia. I would not move back at gun point. I would just let them shoot me. That state sucks.

In California, that would be about right.

Just heard the left state passed a new non-discriminatory law stating that if a 6-18 year old student wants to be treated as a female, but was born male, and they decide because of their sexual orientation, they want to go to the ladies room instead of the men's room, they will be allowed. They cannot be questioned concerning their choice; -- it is their constitutional right.

In addition, they can choose to play on women sport teams as well.

Wanna guess how many heterosexual HS boys will suddenly be bi-gender?

California never ceases to amaze. Amazingly beautiful state, but much of the population reminds me of a cereal; --- filled with fruits, nuts, and flakes.
