I got rear-ended two years ago while driving a company car in a similar situation.

Long story short, I had to explain to the lady that it doesn't make a difference if it is clear or not, you shouldn't even be checking since you can't go anywhere until the car in front of you is gone first.

Some can't grasp that.

Maybe it is a myth that you are "wrong", but the law absolutely says you are indeed at fault.
