If you have a bad EBCM that not available any more, what happens when you take car in for yearly inspection? Does it cause it to fail, and if so what do you do then? By the way I live in Mass.
The Mass regulations go into detail about brake testing - parking and regular - but I saw no mention at all of ABS. This doc is written in legalese, but is the legal basis for their tests..
A Goggle search reveals mixed messages - including one enterprising soul whose "solution" to the problem was to paint over the bulb. I suspect The People's Republic of Maryland, where I used to live would also be a pain. My experience there is that they won't test a vehicle that has warning lights on that should not be on.

Somebody in a different thread who said they live in Massachusetts said a broken EBCM is not a failure in Mass. I believe only 4-5 states nationwide fail if any warning lights are lit. Most states allow a broken ABS system as long as the "regular" braking system works, and I'm 99% sure Massachusetts is one of them.
PA and Delaware both allow non-functioning ABS and Mass has similar inspection rules. I think you're fine.
