Well, you actually are extremely lucky to know that UPS sent him a check!

I went through the same thing with a different seller after buying a $750 top for my previous C5 on eBay last year. He used UPS with insurance for shipping. The top arrived damaged. I filed an UPS claim and UPS picked up the damaged top.

So far, so good. However, 4 weeks later I still had not got a refund from the seller. I tried to check with UPS what the status of the claim is, and if insurance was paid out yet. I was unable to get a SINGLE word out of UPS. They refused to reveal whether the claim was settled or not or if they had paid out any shipping insurance to the shipper or not. UPS told me that they are not allowed to discuss it with me. They can only discuss this with the shipper!

Fortunately I used Paypal for the transaction. Filing a buyer's complaint had no effect. However, after filing an "unlawful use of my Paypal account" complaint to them, they very quickly refunded my money.

So a warning to anybody using United Parcel Service (UPS): The insurance settlement will go to the shipper and UPS is not allowed to discuss any insurance matters with the receiver of the goods. Only the shipper gets to reap the benefits of shipping insurance...

and that is why it is so important to either use COD (preferably),a credit card, or lastly, PayPal for transactions with individuals. Checks are never advisable as the ability to recover funds on screwed up transactions is quite limited and messy.
