Yes, I put back the factory tune and confirmed that is was put back based on the current tune read out - stated factory tune, as based on instruction manual it states that it will read the last tune downloaded. I also checked under the vin and it has my vin # listed. Bottom line I need to know if this unit can be sold as is or thrown in the trash if still locked on my vin?

This tool since it has the old 1.03 revision is still locked even after restoring the backup.
You can send this tool in to be unlocked and updated to the 2.13 revision.
If you have a copy of the receipt, it costs only shipping, if not it is $99 + shipping.
