manual says to check oil when it is "warm." Not to check it when it is cold as in first thing in the morning - I have always check oil level when the max oil has "dripped" down to the pan - that is when fully cold - what do you do???

that's the golden rule as far as i ever knew. you're looking for oil in the pan, not some in the pan and some still up in the top end.
unless they're assuming you didn't check it before starting the engine, then if you run it till it was warm it would drain down faster after shutdown.
That's an interesting thought, as I've alays checked the oil either before I start the car in the morning, or if I driven it for a while, after letting it sit for 10-15 minutes, to let the oil fully drain to the pan.
However, consider this...An automatic transmission is checked while running, and warm. The coolant reservoir has both "cold" and "hot" level lines. Most liquids expand when heated...motor oil too??
