huh? Just curious, what's a State Bar card (are you a lawyer)? And why the 20th?

And yer right, asking for traffic school when you're doing REALLY sick speeds is a slim deal, but hey if you don't try you'll never know .

The beauty of the trial by mail is you can request traffic school as part of your deffense statement. The problem with fighting a ticket in court is that you have a judge in front of all these people that has to set an example. Your chances are slim of getting off easy in any way. With trial by mail, it's the judge in their chambers evaluating your statement vs. the officers statements. It's private, and you probably have a better chance of catching the judge in a decent mood.

First question, yes.

Second, a bunch of So. Cal. Vette owners get together at the Krispy Kreme at the Block at Orange in Orange County roughly every month. Weekend before last was my 1st with 13 Vettes and it was really cool. The next is 3/20 and there's talk of a drive too, and the ladies are to show on the 20th. BE THERE!

In my experience, anything 20mph over the posted limit puts you in a different catagory($$$). In SD you can plead guilty, not guilty or request traffic school. If you haven't been to traffic school in the last 18 months, the judge usally grants it. You'll have to pay the fine plus the traffic school but the ticket will be removed from you DMV record.

I had a similar ticket in San Bernardino county a few years ago. I saw the cop, and I thought he waved for me to go on. He said that he meant slow down! Anyway, it cost me about $200, I think. The ticket, and the online drivers school and test, so it wouldn't go on my record. The test was easy....used 2PC's...one with the questions..one with the answers! Actually the learning part was interesting and quite informative.
Check and see if they offer online drivers school.

I think that in CA there are a couple of limits to traffic school...if you haven't been there in 18 months, and you have to be under a certain spread (i.e. can't be more than 10 mph over). I'm not sure what the spread is, but I think that 20 and over in CA add additional penalties.

I got an 89 in a 55 in Oregon out in the wheat country, but instant-on radar. I wrote a letter to the judge, told him I was speeding, etc. and asked for traffic school. I also mentioned that insurance in CA was high and that anything over 20 mph caused additional penalties. He found me guily of 19 miles over but couldn't allow traffic school because it was too many miles over the speed limit.

That's why a lot of cops write tickes for 14 mph over, or 19 mph over, etc. to keep the ticket and consequences down. By the way, I've never been stopped where I wasn't actually speeding.

In your case, I'd call the court and they can tell you if you can just send in a check, have to go to court to get traffic school, or if you're out of luck and just have to show up and hope the cop doesn't, etc.

OK Champ, I could be wrong, 15 years does not nearly give one the right to think they know squat about squat. However, having sat through a few hundred traffic hearings, you are made well aware of the fact that if you ask for a trial, you forgoe your opportunity to to plead on your case, and ask for traffic school pay the school fee AND the fine.

Cite me the case that NOBODY has been using and is AWARE of, I could stand to make some $ off of this.

In Calif., if you have not been to traffic school in the past 18 months, you can go again, you have to ask to be sent, if you contest the ticket and lose, it's in the judges discretion to send you, not likely though.


And the part that was ABSOLUTELY FALSE was . . . . . .

having just--AHEM!--experienced something similar, it will depend entirely upon the thing you receive in the mail from the local court, i.e., a notice that says "appearance required." if you don't get that, and instead just get a fine, pay the fine, follow the instructions and request traffic school.

if you have to appear, the judge (or administrator) will have his or her own limits with which they'll ALLOW you to go to traffic school, depending on how much over the posted (or in my case, the state) limit is.

if you are required to show up at court, and are eligible for traffic school, tell the judge "traffic school." don't say "guilty" or "not guilty," just "your honor i would like to request traffic school please."

i was enough over the state max that the judge said no. he reduced my fine to around $140-something, which was nice, but that's tiddlywinks compared to the effect on what my insurance will likely be... i'd have paid hundreds of $ in fines to avoid the pain of what's to come...

hope this helps you.

p.s. later that day (after getting the ticket) i bought a new V1. it was a very expensive day...
