my guess your a kinda young guy, Yes confirm it is refundable and if he indicates no tell him politely that is a nonstarter. if he still balks walk away. Despite what the dealers would lead you to believe there are plenty of cars around( just not a lot of Z 51's)
I do beleive they are required by law to have it refundable (at least in CA).
However, they usually don't tell you the are obligated to make it refundable. Instead they say 'don't worry we will refund it because we can sell the car anyway".
When shopping remotely with Maxie Price Chevy, I have put a deposit down before I drove out and picked it up. I asked them about it, and they said that if I didn't like the vette, my deposit could go towards any other vehicle they have or could order. Both times I've visited Maxie Price, I've driven away in a new vette, and they've been near perfect. I didn't ask them or press them if the deposit could be refunded.

That's interesting. It sounds like the Maxie Price deposit is in fact nonrefundable. I don't think I could go that route but thanks for the info.

When I got jacked around by my original dealer re: order status, I discovered the forum, placed an order with Rick Daniel at Les Stanford, then went back to the salesman at the original dealer and asked for my money back. I stressed to him what a nasty thing GM does by not supplying the salesmen who are trying to sell these expensive Chevys and the unfairness of the allocation process... He gave me the deposit back, no problem.
When ordering or taking delivery, the purchase order is a form of contract that would be binding in court if the dealer wanted to pursue. Until you sign the paperwork, and take (PHYSICAL DELIVERY). That would be you, driving the car off the lot, even a short distance, deposits are refundable without the words nonrefundable printed on it in most states.
He should refund the deposit if you don't take the car. If not, ask him why he won't. Tell him that most dealers do and that you will just go somewhere else and he will lose the sale. There are many dealers will want your business and will be straight with you.
