I got a speeding ticket this morning on the way to work. I was passing someone going downhill and happened to accelerate to 79 in a 50 zone. I know... I know... that was irresponsible, but 79 comes at you pretty quick. The cop said that I could probably take the defensive driving class, but when I looked up the stipulations online, it says that driving 25 over excludes me from taking the class.
Does anyone know what my options might be in California? By the way it was the Oceanside P.D. I am from TX and getting ready to move back at the end of Sept. The last time I got a ticket I was still in college; I am 26 now.
Here's the scoop - You can:
A: Pay
B: Go to court and ask the judge for leniency.
C: Go to court and hope the cop does NOT show up.
D: Do C, and if he does show up, just tell the court you are willing to pay and go to traffic school BEFORE and INSTEAD OF B.
If you choose D, you will be in the same boat as A, but might just get lucky and have C happen. It did for me.
get a lawyer and dont give that Cop one red cent. keep postponing it or try and do defer dutification that will drop and be off your record. of if you can do Defer then I would definally get a lawyer and pay the money a few hunders bucks isnt going to be anything of what the insurance company is going to screw you in the years to come you can prob be out 300 or less with a lawyer and i bet it will give you way more trouble than the lousy 300 bucks if you dont higher one. So get you a lawyer keep posponing it until the LEO decides to not show up and he realises dang I can make money money sittin out on the road pulling over more people not messing with a stubborn *** that doesnt wanna give a cop 1 cent
Recently friend of mine was ticketed for going 118 (65 limit) on freeway in his Porche.
Went to court, paid $500.00 fine and the judge let him go to traffic school so no ding on his record.
This was in LA, I presume Oceanside would be the same?

About all I know is there is a ton of cops in Oceanside that all appear to write tickets a lot. I haven't been there in a long time, but before that was there often and I always saw them writing people up. Its a military town and they love making the money off the troops there.
It wouldn't be a big deal if I had to pay the ticket, the problem is with the insurance. I have a tidy little clean record. I have never had an accident and the speeding tickets I received in the past were all able to be dismissed with either deferred adjudication or a defensive driving class. Those were all in TX so, I am sure its apples and oranges.
My court date is sometime in late Oct, but I am moving back to TX next month. I wonder if I can go to court sooner, then ask permission to do the class.
To answer someone else's question it was in Oceanside not Vista.

This is what you do, it has worked four out of five times for me personally. First, since you just got the ticket, don't forget what the cop looks like. Second, you request a court date to fight the ticket/plead not guilty. Third, you postpone that courtdate. Fourth, you go to court and look for the cop, usually won't show up if you have postponed it once. If he isn't there, case dismissed IF he is there, you can ask the judge for traffic school and at that point, you're just screwed

I haven't seen many speeding traps in Oceanside. You don't drive more than 60 seconds at Pendleton without seeing the MP, though.
If someone was able to take the class after doing 115+ in a 60, I feel a little better.

Read the ticket carefully, they usually say to appear on or before Oct XX. That means you can go sooner than Oct XX. However, it needs about a week to process through the system, then you can go to court.

I talked to a CHP who is a friend, he told me that if someone keep posponing the court date then he will make sure that he is there to nail the guy since this is personal. He said that a lot of his poice friends feel the same way.
Do the traffic school thing and take the Traffic shool cetificate with you when you go to pay the fine. It will not be on your record if you go to T.S.
In CA, even if you are not eligible for the standard 8 hour traffic school, a judge can allow you to attend a 12 hour school. There aren't any online shortcuts - you have to sit in a class for 12 hours, but your record will stay clean. Given your record, you shouldn't have any trouble getting this done.
