Thanks for all the replays, here is what has taken place since I posted, My credit union has repeatedly tried to contact the dealer, which is called Texas Direct Auto, located in Missouri City, Texas. and they have not returned the call's , This morning when I talked to the sale manager he told me the car was purchased from another place and they have since gone out of business or bankrupt, and there in legal working to get the title. The credit union has asked me to call them and say that I would like to return the car, because of this, before they hire and attorney to deal with them. I did not put any money down with the dealer.

Yup. "like to return the car?" You mean, you WANT TO and WILL return the car, right? It's not an option for the dealership to say, "no, thanks for the offer. but you keep the car until we can sort this out, if ever."
And I presume you will receive something, in writing, from the existing, still-in-business, dealer that "sold" you this car with no clear title, stating that you have no further liability whatsoever in having taken possession of, and returning the car to this dealership. Along with a receipt stating that they accepted the car back in its as-is condition with no further claims against you.
YOu can even draw up the two papers yourself so you remember to give it to them when you turn in the car and fobs. Simple, one paragraph each for their signature with the vin on each.
Heck, drive the car a few more months making payments as you go. Then if the CU does not get the title return the car, get your money back from the CU and use it for a healthly down payment on a new Vett

Up date on the vette, I talked to the dealership this morning, the fellow told me he has gone to the court house and filed a extenison on the title, the 4th paper tag came in the mail today. I told the dealer that I would like to return the car and they said you can bring it back and resale it to them if I wanted but there not taking it back. I then contacted the Texas DMV office and they could see that the car has not been titled, the orginal dealership that sold the car to Texas Auto Direct has filed for banckruptcy and all there title's are held up in court. So I have filed a complaint with the Texas DMV office against this dealer Texas Auto Direct, also my credit union is now turning it over to there legal department. It's ashame now I've totaly lost interest in the car. But not in getting another one. So well see what the out come is. Will keep posting.

The credit union will return all of his money that he has paid them if the car has to be repossessed because of any shenanigans via the dealer. Right now the car doesn't mean anything to the CU because they haven't paid for it...which means any money he pays the credit union will be returned to him if the contract is canceled on the purchase of the car.
As long as he has a BOS then he has nothing legally to be concerned with.
in my state it takes 6 weeks for a title transfer. i don't know of any dealership that would transfer the title with the credit union as lienholder unless the credit union has paid the dealership. doesn't make sense. if the car was a trade in it could be the dealer is having a problem getting the title from the previous lienholder. still doesn't explain why your credit union hasn't paid for the car.
I tried to deal with Texas Auto Direct several months ago. Spoke with a salesperson on the phone and got a cursing. He hung up the phone on me too. I drove 7 hours to look at a vehicle on their lot and called to ask for directions. The guy asked me if I had an appointment, I told him no. That's when the cursing started.
Update on the 07 vette, well I returned it today under the instructions of my credit union and there lawyers. they told me that being I didn't have a title, or they didn't have a lien or title and the dealership could not issue a title in the required time frame I should return it. When I handed a sales rep. at the lot the key's another manager told me that I couldn't leave the car and that them would repose it. I'm not sure how they could repose it when it's at there lot and I have no proof of owner ship, could some one please explain this to me. Another thing if your in Texas or shop for car's on Ebay look out for this online dealer, Texas Direct Auto.
Here's the latest and hopefully the last post on the car, The dealer contacted my Credit Union Monday and asked them if there were going to allow me to return the car, and the C.U. told them yes and that the deal was off because of the title. I looked on there web site today a the car is listed back for sale at the same price I paid but with the xtra miles that I added in the 2 months I had it. The ad also show's that it has a clear title. Hum.
Any way I have since purchased another Vette a 2008 Machine Sliver /Blk Coupe 3LT, with 2519 miles still smell's new and this one has the title.

You are completely off the hook here.The title is not in your name.
The loan money has not been paid to the dealer.
DMV has no record of you owning the car.
Technically,that car is not yours!!Go drop it off and tell the dealer to take you to court.Find a better dealer to do business with!

Interesting story. You did the right thing and are going to be much better off. That dealer knew they had a problem with the title and were stringing you along buying time in the hope you would not pursue them for title. Your CU did right by you.
