So far all we know, according to the buyer, is that the seller said the door was “complete”, which the buyer apparently interpreted as it having all the bits and pieces and they are all fully functional. It's an easy assumption to make and a question to the seller could have confirmed it. Based on that, I think the buyer should let it go, buy himself a new motor, and call it a day.
I've tried twice and paypal was totally useless! So now we see both sides. paypal is owned by ebay so that should pretty much put it in perspective!
I've had to dispute several times with Paypal for purchases on Ebay and I won each time. So I would not say it is useless. Make the proper attempts to correct, submit the relevant docs and if you are right in your claim you will more than likely win.
How old's the door and how was it transported or shipped? Vibration, setting the door down hard or dropping the door anywhere in transit could have resulted in damage. The door could have been fine at the time of sale and defective after delivery. Happens all the time with older items and may have nothing to do with the seller's integrity.
Is there a possibility you could have damaged all or any part; door, motor, wires, etc. in disassembly without knowing it?
There's not enough information here for us OR an arbitor to make a judgement call. You'll need to provide more facts, pictures, etc..
As far as the seller not wanting to return $110, you didn't state what you paid for the door. You may have gotten a smoking deal and the amount you're asking for in return is unreasonable.
Hope it works out for both of you, assuming you are both men of integrity in an unfortunate situation.
Sign me up in the list for winning paypal disputes... of course, I only do it when it's worth it and when I know I'm right, have all emails and original description of item.
so in this case, I would say if the description said everything worked (not just excellent condition... that could mean anything) or if the OP emailed asking if everything worked and seller replied with YES it's no problem.. and OP easily will win through PP or CC.
He isn't going to win, period, end of discussion just because he used his credit card. He received said product, he has to prove his case..credit cards don't refund money just cause you file a grievance.
First of all, there are 2 sides to every story and without ALL the facts it's hard to make any determination however............
I have been in the credit card processing business for almost 20 years and have thousands of customers. My experience is that VISA/MC will side with the consumer (customer) 95% of the time. VISA/MC makes it very difficult for a business to win a chargeback claim even if the business is right. Therefore, as a customer the OP should be able to get his money back thru VISA/MC.
