Update 9/19/2017

The car has been at the shop so far, nothing has been done yet :/ (Thank you Irma), the bodyshop put an estimate together for the total of over 6K yet it is not a fix number yet and still waiting on the mechanical part of the estimation. I am a bit scared that they might give my car a total loss... What do you guys think?

That said, my insurance is obsolete since they subcontract the job to AGERO making them principally responsible for everything.

So you recorded the entire towing setup with a third party photographer, step by step, and you called the police to a civil dispute as a means of securing eye witnesses to the property damage? Sounds kind of like a little scam to me pal.

Only if you think the car is worth $10K-$11K. I saw a C5 in town a few months ago that was rearended. $10K of repairs and back on the road. But every situation is different. We shall see. Thanks for keeping us updated.

The third party will be me taking the pictures before putting it on the ramp, while putting it on the ramp and after it was put down...
You are judging me over getting eye witnesses...???
It is my right to call the cops and file a report. Let me ask you, are you a lawyer? Work for an insurance company? because i don't and i'am not..
The fact that i cover my *** doesn't make it a scam if you are slow on the head and don't take the precautions in such cases that is all you "pal".
Some people should stay off the forums sometimes

The holes in the frame are behind the front wheels aren't they? Doesn't seem like you could pull the car up on the flat bed with the hook in there....also the hook would like damage the fiberglass around the holes...???

I wanted to offer a post defending you, prior to seeing your own answer. But, my experience with that person is that he is a self-proclaimed expert on all things, and you can never win, so why bother?

Your photos are fine I was a LEO for 25 years and people took their own photos for court all the time especially civil court so no worry. Criminal court is a bit touchier, your were smart to document it no questions with photos.

Thanks man! Its bad enough that i am going thru all this mess, i don't need any dumb assumptions from a guy that might have watched too many episodes of CSI

Oh man thanks!! Coming from a former LEO i sure as heck now i don't feel so dumb or a criminal for taking such pictures !!

10/10/17 Update

As of today the car remains at the mechanic shop (10/10/17) its been almost 2 months from the incident.

*9/22/17 Car is still at the mechanic shop (Redline).
"Jerry" (AGERO DAMAGE SPECIALIST) took over the case on 9/16. He was requesting additional pictures in order to send an adjuster. On 9/18 pictures were sent to him via email. He is requesting a FULL ESTIMATE from the body-shop and mechanic shop. A preliminary estimate was sent to him leaving an opening for "supplements" or additional damages that requires the for any unseen damages or extras. He claims that he needs an exact number yet the body-shop or mechanic shop can only give him a most accurate estimate hence "preliminary estimations".

9/22/17

Been trying to get a hold of "Jerry" since 9/21/17 without any luck. Leaving voicemails and waiting for a response.

9/28/17

Called AGERO and spoke with another specialist from the so call DAMAGE TEAM and was told that they need to have a full estimate and to investigate if the towing carrier is liable for the damages (the nerve on this guys). Jerry is no were to be found...

9/29/17
I am fed up, called them and left a nice but calm message wanting a prompt solution to the matter and considering to go to the lawyers about it.... 10 min later guess who?! Jerry call, saying that he will have a third party adjuster out to estimate my car...finally! they should have done this weeks ago!

10/02/17
Third party adjuster stopped by the mechanic shop (Redline) and literally stayed for 5 min not even given a chance to the mechanics of any input on the findings or damages, i had requested a courtesy call so i can be present at the time of the adjuster...not given, no wonder...
Called the adjuster and he did not give me any answers, he was very dismissing.

10/02/17 Called AGERO (Jerry) left a voicemail and yet no answer as of 10/10/17.

Its been almost 2 months since the day of the negligent, body-shop and mechanic shops had given "preliminary estimations" already, no rent a car, was told that they will cover $30 a day for a rent a car but i will have to pay them out of my pocket and they will reimburse me at the end of the process, i asked to put that on writing and they denied it.
AGERO keeps delaying the process just last week they sent an estimator or adjuster to take a look at the car, at this point even the mechanic shop wants to get the car out of there and i do understand they been waiting as long as i have.
I asked to elevate the case to the supervisor and i was told as of today 10/10/17 that Jerry's direct supervisor will contact me before the end of the day.

At this point i am expecting for the worse, this guys just don't care...anybody that has calm and clear head at this moment that can help out with some input will be greatly appreciated because as of this moment i see all cloudy and about to explode of anger.

Sorry to hear your bad experience. when I had issues with insurance companies and could not get an answer I would call the insurance commissioner in the largest city your in and file a claim with them notting how poorly you are being taken care of, when I did this I had checks from both insurance companies (mine) and(theirs) in three days, funny how fast they worked then...good luck.
