there is a slight gap on both of it after installation is that normal
Well, gee, I'm flummoxed. Did you forget the word "ends"? Did you do the install? Did you use tape or bolt it down? Were the installation instructions followed? Any pictures?

bolted down ends look good but closest to third brake light slight gap
OEM should fit just fine. Maybe you didn't drill the holes big enough for a little play and the spoiler was put in a bind as you tightened it up or it is not sitting flush against the body because of this.

its OEM just gap as water slides through.can see a little daylight if looking from behind .
Loosen up all of the bolts slightly. If there isn't any play in the holes so that the spoiler can move slightly with the bolts slightly loose then the holes are not big enough.
If there is no allowance for a slight movement as you tighten the bolts part of the spoiler can get in a bind and not lay flat.
If it will lay flat (or very close) when there are no nuts on the bolts, then it is not the spoiler but the installation. If it won't lay flat, you may have to enlarge the holes slightly.
Also, it must be centered and you should probably "hand snug" all of the bolts and then tighten them from the center out to each end..
