As long as it was tuned right you shouldn't have any issues. Ultimately, it really depends on how strict your state is. California? I wouldn't chance anything in that crazy state. New Hampshire? They don't do emissions I think...

Yes, it can pass without cats or even oxygen sensors. All that's required is an HP Tuners interface and knowing what to change in the tune, which I can share if you get to that point.
My car has A & A S/C, Belanger Custom Tri-Y headers, Magna Flow High Flow cats, and both the upstream and downstream O2 sensors, and runs cleaning than it did stock. Passes metro Phoenix emissions with flying colors. Now that the car is more than 15 years old, and has collector car insurance, I can now get an emissions waiver. No more waiting in line at the emissions test station every other year! Yea!!
