Default Found GMS pricing but dealer want $2K non-refundable ...

deposit for a Museum delivery. This is probably a deal breaker for me, but I wanted to know if this was standard practice for a Museum Delivery? Or are they trying to back out on the GMS pricing offer?

They might not even of any allocation. It's easy to say they will sell at GMS take the $2k knowing they won't be able to get a car. Then just keep putting you off.

By law......... There is no such thing as a non-refundable deposit. If they intend to keep this money if you decide not to purchase the car, they must call it something else, such as a retention fee.

All deposits must be returned upon request. I would suggest giving them the deposit on your American Express card, so if they try to keep your money, all you have to do is dispute it with Amex who will charge back the dealer.

More importantly though......... Do you really want to do business with a dealer who is trying to lock you in based on a lie, or worse, ignorance of the law.

It might be the case they do not want the buyer to back out of the deal and have to pay to have the car shipped back to the dealer.

The dealer might just be concerned about his cost getting the car to his dealership if, for some reason, you don't purchase the car.

Why not ask him?

Default GM Supplier and Deposits

My dealer wanted a $2,500 deposit for a car ordered with GM Supplier discount and an R8C delivery. We discussed it at length and I agreed to it. While my car has nothing unique (LMB/Cashmere/MN6/Z51/1SB) I could understand his concern about ordering a car for someone in Virginia for delivery in Kentucky for a dealership in Montana.
Remember, once the car is delivered across the road to the museum it has effectively used the $800 transportation charge which, if the deal fell through, would have to be provided by the dealership to get the car to Montana.
The question of refunds never came up and while my car was completed last week I will pick it up from the Museum on 2/3 - if there is no snow of course.
I thought that this was a reasonable charge for the dealer, especially since I was able to get both GM Supplier and GM Loyalty discounts to go with what I am sure will be a fantastic experience at the Museum.

How long does one have to work at a GM supplier to get the discount? If I could find a supplier nearby and get a minimum wage job, work one day and then quit, could I get the big discount off a Z06?

It's my understanding that you have to be working for the GM Supplier when you take delivery of your new ride. Of course, if you could find the car you want sitting on a dealer's lot your scenario would work but if you needed/wanted to order one you might be leaning on that broom longer than you thought!

purchase agreements for a house,lot,and car really protect the hell out of the buyer,but not much for the seller-most don't even cash the check - but if they sold the property to a higher bidder then they are screwed - so it's not an unreasonable deposit, your money would be safe

I'm picking my GM Supplier C6 up on Thursday (assuming it actually arrives - damn union truckers!), I'll ask him if he will do GMS for a museum delivery. His allocation is only 2 a month, but if you get in on his Feb cycle it won't take that long to get your ride.

Full time employee for at least 6 months. And with a Vette, you have to retain it for 2 years.

GMS and GM Supplier are not the same thing. GMS, which is for GM Employees (and I believe dealership employees too), is more better.

lawman31, a non-refundable deposit is just that. It is implied that a deposit or earnest money is refundable if not written otherwise into the CONTRACT. Of course the contract must comply with whatever the State Laws are concerning the type of transaction.

Just like the price you pay for a car, the deposit is negotiable, so is any amount of non-refundable deposit. It makes good business sense for the seller to have this as it is assurance if the sale is not completed by lack of performance from the buyer, the sellers "liquidated damages" are covered without courts.

Since others have paid non-refundable deposits in the approximate amount your dealer has suggested, it sounds like a reasonable business practice. Just do some due diligence on your seller to see if the dealer has a good reputation for delivering what they promise.

I must be lucky...I look FORWARD to going to work on Mondays. I love my job...and they PAY me!?!?!

This is the reason, most if not all forum dealers require non refundable on drop ship and NCM only

If you are talking about GMS - as in employee pricing, GM strictly prohibits a dealer from requiring any extra fee for a GMS priced car (assuming you really mean a "charge", not a deposit). They must sell it for the GMS pricing on the invoice, or not handle it as GMS at all. This is because GM actually pays the dealer a handling fee for selling the car at that price.
