this is a subjective evaluation of how dirty it is. No set rule. As for cleaning didn't they give you a kit, cleaner and re-oiling spray? If not, simple green and warm water will clean it well enough, but each manufacture usually has there own special oil, K&N,Blackwing, etc. Have had both..
That kind of oil will clog up the filter. Call them and ask if they have an oil or can reccommend one. If not, then I would use K&N's oil in the aersol spray can, not the pump spray. It also sprays much better than the Blackwing oil. It spits oil ,not a fine spray like K&N.

Much worse then clogging the filter, it will gunk up the MAF and cause poor performance . Even the recommended filter oil will affect the MAF if too much is used. The high performance filters go a long way before they need cleaning.

I thought spraying with WD-40 worked pretty good? Any thoughts or feedback?
Thanks for all the great advice guys...I wasn't aware that a spray was made but will sure look for it. I guess the idea is to get one that is really light ?
