08 corvette ls3, 2nd gear issues

08 corvette ls3, 2nd gear issues UPDATE FROM DEALER
so I have been having some second gear issues really ever since I got the car, it would seem if im on street tires, and the car was spinning, it would reject me from going into 2nd gear. On DR's it never did this. So ive just tried to avoid it. I like to go into second around 50 mph if i want to punch it for whatever reason. well now the car WILL NOT go into 2nd gear at 50mph...well it will but the noise is horrible coming from the shifter. any ideas, car has 16k miles and is stock other than an axleback corsa.

update, car was at dealer all day.
a. tech drove car was able to duplicate problem, said it was a blocking ring.
b. he got the manager to ride in it wasnt able to duplicate the problem..
basically told me to kick rocks the cars fine.
I went up there got another manager in my car FINALLY drove and duplicated the problem 3+ times.
the checked the puter on the car, all was clear (the car is stock besides an axleback exhaust)
they want me to wait till the GM rep comes now.
Im concerned im in the process of getting dicked, it is a CLEAR problem the car will not go into 2nd over 50 mph.

Is that a bad thing, is it just a CYA thing for the dealership. Also I dont think they like the fact i didnt by the car from them there is a pin mark where the car was purchased from.
